SUBJECT: Proposed Amendment to Resolution No. 197-25; A Resolution Accepting
the Dedication of Roadway Lot 8, Identified as TMK No. (3) 3-5-008:009,
Situated on the Northerly Side of Hawaii Belt Road and on the Southerly
Side of the Old Mamalahoa Highway, at Papa`aloa, North Hilo, Island and
County of Hawaii, State of Hawaii from Hamakua Housing Corporation.
Transmitted herewith is a proposed amendment to Resolution No. 197-25. The amendment is
shown below in Ramseyer format with respect to the content of Resolution No. 197-25; material
to be deleted is bracketed and stricken and material to be inserted is underscored.
1. Resolution No. 197-25 is amended by amending the title to read as follows:
"A RESOLUTION ACCEPTING THE DEDICATION OF ROADWAY LOT 8,
IDENTIFIED AS TMK NO. (3) 3-5-008:009, SITUATED ON THE NORTHERLY SIDE
OF HAW_ AI`I BELT ROAD AND ON THE SOUTHERLY SIDE OF THE OLD
[ ] MAMALAHOA HIGHWAY, AT PAPA`ALOA, NORTH HILO,
ISLAND AND COUNTY OF HAWAI`I, STATE OF HAWAI`I FROM HAMAKUA
HOUSING CORPORATION."
2. Resolution No. 197-25 is further amended by amending the first WHEREAS clause to read
as follows:
"WHEREAS, Hamakua Housing Corporation, a Hawaii Nonprofit Corporation
(hereinafter "Owner"), is the owner of Roadway Lot 8, identified as TMK No. (3) 3-5-008:009
(hereinafter, the "Roadway"), situated on the northerly side of Hawaii Belt Road and on the
southerly side of the Old 1-11] Mamalahoa Highway at Papa`aloa, North Hilo, Island
Comm. No. •

and County of Hawaii, State of Hawaii, as described on Exhibit "A" and delineated on Exhibit
"B", which are attached hereto and made a part hereof, and"
3. Resolution No. 197-25 is further amended by amending the final WHEREAS clause to read
as follows:
"WHEREAS, Article XIII, Section 13-12 of the Hawaii County Charter provides that the
Council may accept gifts, including real estate or any interest in real estate, on behalf of the
County of [aii;] Hawaii; now, therefore,"
4. Resolution No. 197-25 is further amended by amending the BE IT FURTHER RESOLVED
clause to read as follows:
"BE IT FURTHER RESOLVED [uBYTHE COUNCIL OF T14E COUNTY of
MAMAI11, in accordance with Article XIII, Section 13-12 of the Hawaii County Charter and
Chapter 23 of the Hawaii County Code, that the County of Hawaii accepts the dedication of the
Roadway for public road purposes."
Due to the limited scope of this proposed amendment, a copy of the new draft of this resolution
that will result if it were adopted is not attached.
