BILL 24 (DRAFT 5) - AN ORDINANCE AMENDING CHAPTER 25, ARTICLES 1, 2, 4, 5, AND
7, OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO
TELECOMMUNICATION ANTENNAS AND TOWERS

Re: Testimony providing comments for Bill 24 (Draft 5), with clarifying amendments
Aloha Honorable Chair, Vice -Chair, and Council Members:
Thank you for the opportunity to provide testimony on Bill 24 (Draft 5), which proposes amendments to
Chapter 25, Articles 1, 2, 4, 5, and 7 of the Hawaii County Code 1983 (2016 Edition, As Amended)
relating to telecommunication antennas and towers.
Because the bill focuses on updating the county ordinance regarding non-wireline facilities, specifically
telecommunication antennas and towers, Hawaiian Telcom strongly supports the proposed clarifying
changes to Bill 24, Draft 05, underscored in bold below.
Amend section 2, Subsection 2:
(2) Does not include:
(A) Portable, handheld, and vehicular transceivers or radios; [industrial] o

(B) Industrial, scientific, and medical equipment operating at frequencies designated for that
purpose by the Federal Communications Commission -FCC); ["marketed] --- "-
(C) Marketed consumer products, such as microwave ovens, citizens radios, ham radios
[and remote control toys;], or remote- controlled devices, [ and facilities]
(D) Facilities solely for the [ receiving] personal reception of these transmissions,
[including individual] such as radio and television appliances[.]; [j
Q Small wireless facilities, as defined by the Hawaii Revised Statutes, section 206N-1 et

(F) Broadband services delivered through wireline technologies, such as Digital

These amendments are crucial for ensuring the bill's objectives are clearly understood and effectively
implemented.
We respectfully request the Council to adopt these clarifying changes to Bill 24, Draft S, to ensure the
effective and efficient implementation of the bill's intent and provisions.
Hawaiian Telcom appreciates the opportunity to testify and the Council's consideration of the proposed
amendments.
