RE: Bill No. 47, Ordinance Amending Chapter 6 of the Hawaii County Code
Aloha nui kakou, aloha Chair, Vice Chair, and members of the Council,
I'm John Pelletier, a resident of Kona, and I'm testifying in opposition to Bill 47.
Bill 47 proposes to amend Chapter 6 of the Hawaii County Code, adding a new article
establishing requirements that operators of Transient Vacation Rentals register their
rentals with the county, either hosted or un-hosted, including provisions for
enforcement, penalties, cancellation, and the use of hosting platforms.
However, Transient Vacation Rentals are not legally enabled within Chapter 25 of the
"Zoning Code". Therefore, before considering a program within Chapter 6, for the
registration of individual Transient Vacation Rentals, it is in the best interests of the
County of Hawaii to establish a section for Transient Vacation Rentals within Chapter 25
that would address conditions and policies such as permitted land use districts,
requirements for use permits, public works requirements, allowable uses, and standards
related to the maximum number of rooms dedicated to transient visitor rentals or a
maximum number of guests within the principal residence or secondary structure, and
parking requirements.
At the May 6, 2025 hearing of the Policy Committee on Planning, Land Use, and
Economic Development, the introducers of this bill made a point of saying this would
not impact Chapter 25. 1 strongly believe that defining Transient Vacation Rentals in
Chapter 25 should happen first, and Bill 47 should be deferred until that happens.
