Opposition to Bill No. 47 draft 2, Ordinance Amending Chapter 6 of the Hawai1 County Cod'
Dear Holeka Inaba, Council Chair and Members of the Hawaii County Council,- -
If Bill 47, amending Chapter 6 of the Hawaii County Code, is adopted, it has been suggested that the
registration of TVR businesses would violate Chapter 25. See below:
Section 25-4-3. Establishment of permitted uses. The permitted uses as listed in the
regulations for each zoning district may be established within that district after compliance with
the specific regulations of the district and the general regulations of this chapter. (1996, ord 96-
160, sec 2; ratified April 6, 1999.)
Section 25-4-4. Uses prohibited. Any use not listed among the permitted uses in a zoning
district is a prohibited use within that district, except as otherwise provided in this chapter.

Therefore, the Department of Finance should not be directed to register TVR businesses before Chapter
25 incorporates TVR provisions and policies, such as, but not limited to:
• permitted land use districts,
• public works requirements,
• standards related to the maximum number of rooms dedicated to transient visitor rentals and/or a
maximum number of guests within the principal residence or secondary structure,
• parking requirements.
Please consider the following amendment to Bill No. 47, draft 2:
"Section 6-45. Registration.
(a) A person may not register a TVR on M property unless and until Chapter 25 of the Hawaii County
Code has been amended to adopt zoning provisions and policies related to TVR."
Thank you very much for considering the potential costs, benefits, and needs of the entire community
regarding TVRs before initiating the registration of individual businesses.
