Kimball, Council Member„ _ Council District 1 SUBJECT: Proposed Amendment to Bill No. 59; An Ordinance Amending Chapter 24, Article 9, of the Hawaii County Code 1983 (2016 Edition, as Amended), Relating to Pedestrians. Transmitted herewith is a proposed amendment to Bill No. 59. The proposed amendment is shown below in Ramseyer format with respect to the contents of Bill No. 59; material to be deleted is bracketed and stricken, and material to be added is underscored. SECTION 1 of Bill No. 59, which amends chapter 24, article 9, section 24-249, of the Hawaii County Code 1983 (2016 Edition, as amended), is amended by amending subsection (b) as hereinbelow provided: "(b) Notwithstanding anything to the contrary, a person convicted of a violation of subsection (a) is subject to: (1) For any violation not within one year of a previous violation: (A) A fine not less than $250 and not more than $1,000; (B) Community service no less than [fifty] ei_ h� hours nor more than [t-we hurA-r-ed] seventy-one hours; or (C) Both. (2) For any violation within one year of a previous violation: (A) A fine not less than $500 and not more than $1,000; (B) Community service no less than [ane hthidr-ed] thirty-six hours nor more than [tw mod] seventy-one hours; or (C) Both."
