The purpose of this letter is to respectfully request the Council approve that the following contracts
for Legal Services in the above entitled case be increased accordingly:

RE: Communication No. 7r,4 William Silva, et al., v. County of Hawaii, et al.,
Civil No. 97-622 (Hilo), Request for Approval to Increase Special Counsel
Contracts.
Pursuant to Section 1(e) of Rule 4 of the Rules of Procedure of the Council of the County of
Hawaii, this written request is submitted with my approval that the above-referenced matter be
waived from the Committee on Finance to the full Council for immediate action. In reviewing
this matter, timely approval is crucial. It is therefore advantageous that approval is granted and
the matter placed onto the next Council agenda for review. However, in the event this request is
denied, for whatever reason, I understand the matter shall be referred to the Committee on
Finance for placement on its future agenda.

RE: Resolution 249-00, Resolution Authorizing the Funding Increase of Special
Counsel Contracts for William Silva, et al., v. County of Hawaii, et al., Civil
No. 97-662 (Hilo).
Dear Chairperson Arakaki:
The Office of the Corporation Counsel respectfully requests that the above resolution be waived
from the Committee on Finance and heard by the Council at-large. The reason is that the County
is delinquent in reimbursing the attorneys in this case for legal services previously rendered
during the trial and the preliminary work on appeal. As you know, the account for Special
Counsel did not have sufficient funds to reimburse the attorneys and recently, the County
Council approved the Corporation Counsel's request to transfer $360,000 into the Special
Counsel account. This transfer will enable our office to become current on the invoices for
services rendered. Special Counsel have been very patient in waiting for the appropriate action
that would allow our office to tender payment.
