I appreciate your bringing this matter to our attention out of an "abundance of caution." After a thorough review of the information presented in your letter, the Office of Justice Programs finds no grounds for debarment exist with respect to Hawaii County under our debarment regulations (28 C.F.R. S. Hong, and I am an Assistant Corporation Counsel for the County of Hawaii. I represent, Chief of Police Wayne G. Carvalho. 1 was referred to you by Ms. Ellen Harrison, Senior Attorney for DEA. My client and I need your assistance in a very important matter. Pursuant to Section 67.311, Code of Federal Regulations (hereinafter referred to as "CFR"), the County of I iawaii, on behalf of Police Chief Wayne G. Carvalho, would like to bring to your attention, information that may qualify and be "Information concerning the existence of a cause for debarment and may affect the County's ability to apply for, continue to receive DOJ and DEA funds. Se, Sec. 67.311, CFR. Additionally, pursuant to Sec. 67.310, CFR, the County of Hawaii respectfully requests the opportunity to informally resolve any concerns that you or your department may have with the County of Hawaii's full cooperation. I have attached a copy of a letter I submitted to Mr. Steven Kaufman, Senior Attorney, at DEA. Ideally, I would like to obtain your formal notification that with respect to Chief Carvalho's Letter to Ms. Schwimer June 20, 2000 Page 2. certification on prior grants, no further action and disclosure are necessary, that his certification is acceptable, and the County and Chief Carvalho may continue to apply for, accept and spend federal funds for such important grants as those listed in order to protect the health, safety and welfare of our community. I respectfully request you review the letter and attachments, and if you are not the appropriate person to address my concerns, please refer my request to the appropriate division.
