J�SY Gi k,�1 <br />COUNTY OF HAWAII <br />4TE 60F•H,.1� <br />ORDINANCE NO. <br />STATE OF HAWAI`I <br />BILL NO. 29 <br />(DRAFT 2) <br />AN ORDINANCE AMENDING CHAPTER 25, ARTICLE 3, SECTION 25-3-3, OF THE <br />HAWAI`I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO THE <br />ESTABLISHMENT OF ZONING DISTRICTS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: <br />SECTION 1. Chapter 25, article 3, section 25-3-3 of the Hawaii County Code 1983 <br />(2016 Edition, as amended) is amended by amending subsection (a) to read as follows: <br />"(a) Any of the districts listed in sections 25-3-1 and 25-3-2 [a�ef-�] shall be <br />established for any portion of the County by being described by metes and bounds <br />and in map form[:] as prepared by a licensed surveyor; except that, when deemed <br />appropriate by the director, other means of description may be used in lieu of metes <br />and bounds to establish any district under section 25-3-2. In case of conflict <br />between a zoning map and metes and bounds description delineating district <br />boundaries, the latter shall control. In case of conflict between a zoning map, and <br />any summary of ordinances as provided by subsection (d) below on one hand, and <br />duly enacted ordinance on the other, the provisions of the ordinance shall be <br />authoritative. As between ordinances, the provisions of an ordinance enacted later <br />in time shall control." <br />SECTION 2. Material to be repealed is bracketed and stricken. New material is <br />underscored. In printing this ordinance, the brackets, bracketed and stricken material and <br />underscoring need not be included <br />SECTION 3. Severability. If any provision of this ordinance, or the application thereof <br />to any person or circumstance, is held invalid, such invalidity shall not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or <br />application, and to this end, the provisions of this ordinance are declared to be severable. <br />
