AN ORDINANCE AMENDING CHAPTER 4, ARTICLE 3, OF THE HAWAI`I COUNTY
CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO ANIMALS.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I:
SECTION 1. Chapter 4, article 3, of the Hawaii County Code 1983 (2016 Edition, as
amended) is amended by adding a section to be appropriately inserted and to read as follows:
"Section 4-3- . Feeding prohibited.
(a) A person may not feed or attempt to feed a stray or feral animal on property owned,
leased rented managed, or operated by the County, unless the person is a certified
community cat caretaker who is authorized by the animal control and protection
agent tough an annual contract for a community cat management program to
feed and care for stray and feral cats at designated locations and times, as
determined by the animal control and protection administrator.
,(b) AM person convicted of a violation of this section is subject to a fine not more than
$50 for the first violation and not more than $500 for any subsequent violation.
(c) For the purposes of this section:
"Certified community cat caretaker" means an individual who has:
(1) Completed Count' -approved, standardized training courses in colony
care, best practices in feeding stray and feral cats, environmental and
public health impact mitigation, trap -neuter -vaccinate -return -manage
procedures, and recordkeeping_and reporting requirements,
(2) Signed a written agreement with the ColMly to comply with the
provisions of this section; and
(3) Received a certified community cat caretaker identification card and
number from the animal control and protection administrator.
"Feed" means to deliberately introduce any food material, substance, or
attractant directly to or in the vicinity of an animal.
"Feral" means undomesticated or living in a wild and unconfined state.
(d) Nothing in this section prohibits, restricts, or limits the ability of the County or of a
person authorized or contracted by the Cogpiy to trap, remove, impound, or seize an
animal or to undertake an other power or duty under this chapter of the Hawaii
Revised Statutes, chapters 142 or 143."
SECTION 2. New material is underscored. In printing this ordinance, the underscoring
need not be included.
SECTION 3. Severability. If any provision of this ordinance, or the application thereof
to any person or circumstance, is held invalid, the invalidity does not affect other provisions or
applications of the ordinance which can be given effect without the invalid provision or
application, and to this end the provisions of this ordinance are severable.
SECTION 4. This ordinance shall take effect on January 1, 2026.
