SUBJECT: Proposed Amendment to Bill No. 51, Draft 3; An Ordinance Amending
Chapter 4, Article 3, of the Hawaii County Code 1983 (2016 Edition, as
amended), Relating to Animals.
Transmitted herewith is a proposed amendment to Bill No. 51, Draft 3. The proposed
amendment is shown below in Ramseyer format with respect to the contents of Bill No. 51, Draft
3; material to be deleted is bracketed and stricken, and material to be added is underscored.
SECTION 1 of Bill No. 51, Draft 3, which amends chapter 4, article 3, of the Hawaii County
Code 1983 (2016 Edition, as amended) by adding a section, is amended by amending subsection
(a) to read as follows:
"(a) A person may not feed or attempt to feed a stray or feral animal on property owned,
leased, rented, managed, or operated by the County, unless the person is a certified
community cat caretaker who is authorized by the animal control and protection
agency through an annual contract for a community cat management program to
feed and care for stray and feral cats at designated locations and times as
determined by the animal control and protection administrator. A cat management
program shall not be established on any County property that is located:
(1) Next to the shoreline,
(2) Within fifty feet of a stream,, or
(3) Where there is a documented risk of the program violating the Hawaii
Revised Statutes, chapter 195D."
Due to the limited scope of this proposed amendment, a copy of the new draft of this bill that
would result if it were adopted is not attached.
