HomeMy WebLinkAboutRES 288 Draft 01 2024-2026A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAI‘I, THE COUNTY OF KAUA‘I, THE COUNTY OF MAUI, AND THE CITY AND COUNTY OF HONOLULU
FOR THE PURPOSE OF ADMINISTERING CERTAIN PROVISIONS OF ACT 96, SESSION LAWS OF HAWAI‘I 2025.
WHEREAS, Section 46-7 of the Hawai‘i Revised Statutes requires the consent of the Council in order for the County to enter into an agreement with the federal government or any other
public body respecting action to be taken pursuant to any of the powers granted to the County by law and furnish, expend, and receive any funds or other assistance in connection with
projects being or to be undertaken pursuant to those powers; and
WHEREAS, Act 96, signed into law by the Governor on May 27, 2025, makes gross rental proceeds from cruise ship fares subject to the transient accommodation tax (TAT), prorated by the
percentage of days docked in any port in the State to the total number of days of the voyage; and
WHEREAS, the relevant fiscal agencies and departments of the State and various counties have agreed on a method of allocation of the TAT in cases where a cruise ship docks in two or
more counties during a single day; and
WHEREAS, the purpose of this agreement is to facilitate the orderly and uniform administration of the TAT on cruise ships across the State; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that, pursuant to Section 46-7 of the Hawai‘i Revised Statutes, the Mayor is hereby authorized to enter into an agreement with
the State of Hawai‘i, the County of Kaua‘i, the County of Maui, and the City and County of Honolulu for the purposes hereinabove described.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable C. Kimo Alameda, Mayor of the County of Hawai‘i; and Diane T. Nakagawa, Director
of Finance.
