Yesterday afternoon, I received the attached E-mail from Special Acs: ifomas K. Aiu
of the Drug Enforcement Administration (DEA). This E-mail was sera DEA Attorney
Ms. Ellen Harrison to SA Aiu as a result of her meetings last Tuesday with
Assistant Corporation Counsel Ted Hong and members of the Hawaii C, . rry Council.
It is my understanding that officials of the Department of Justice (DI-1. , : r ice of Justice
Programs (OJP) and DEA officials confirmed that DOJ regulations rco reporting of
certain civil judgments are directed toward findings of fraud in financi_ _I_Aters and not
toward all alleged fraud. This is consistant with the initial interpret- n by Mr. Hong
and Council member Bobby Jean Leithead-Todd.
In summary, DOJ and DEA officials have agreed that the County can n'rinue to apply
for and receive DOJ and DEA funds. I am certain that Mr. Hong wil her clarify this
matter with the Council at its next meeting when this matter is hearts.

During my meetings Tuesday with the Assistant Counsel Counsel, Te_' r~y, and the county
council members. I agreed to find them a point of contact within the Departm - Justice who could
provide definitive guidance on the requirements of the suspensionldebari r'.rfication.
Earlier this morning, I spoke with Cynthia Schwimer, the Controller ol - -~W Office of Justlciar
Programs (OJP) and Stacy Worthington of her staff We briefly discussed th cncll's concerns,
and I faxed Ms Schwimer a copy of Mr. Hong's 6/2/00 letter, They agreed 'r )f course, the
county can continue to apply for and receive 00J and DEA funds. They alsn rmed that the DO-i
regulations requiring reporting of certain civil judgments are directed toward ,?s of fraud, etc., In
financial matters, not toward all alleged fraud.
They also advised that all Mr. Hong's telephone calls were not waster ^r all Mr
Worthington told me that he had recently received an e-mail message from ;h unty Counsel
about the civil judgment against the chief and that he had written back, askirv
a) is the Chief a "principal" who would be directly involved in administ- r a grant? and
b) did the lawsuit involve misuse of funds?
Finally, they offered an attorney in OJP's Office of General Counsel E- iture point of
contact for Mr. Hong. Andrea Grill can be reached at (202) 514-2125. 1 wil! reach Mr. Hong
and provide this information.
