RE: BILL 29 Amending Chapter 25, Article 3, Section 25-3-3 of Hawaii County
Code... RELATING TO THE ESTABLISHMENT OF ZONING DISTRICTS WITHOUT
USING METES AND BOUNDS
Aloha County Council,
The enactment of Bill 29 would pave the way for the County to use other means of
identifying land to enact special zoning districts that are proposed in the 2045 General
Plan. The proposed zoning changes were available on the Planning Department website. It
was called the "Change Map" where you could enlarge the map and click on your TMK and
see what the old zoning was and the proposed new 2045 zoning would be.
For some reason the "Change" Map has been removed from the Planning Department
website and we are left with only the 2045 GP Zoning Map, which I checked the morning of
7/21 /2025 and it still shows 2018 lava on my land and nearby neighbors land which does
not have lava on it. If that 2045 GP map is wrong on my land, how many other thousands of
TMK's are erroneously gonna be "taken" by the County from Agriculture to non -usable land
using computer overlays instead of doing the actual work of metes and bounds?
I have written the developers of the 2045 Gen Plan and the Planning Department asking for
the "Change" map to be re -instated on the Planning Department website as the 2045 Plan
is still going through review this year and into the next. People have to be able to see how
their, land will change zoning and what they will be required to do if they somehow find they
now own Nature or Conservation land. The 2045GP states landowners must survey all
plants, remove invasive plants and only plant approved plant can be grown (at the expense
of the landowners of course) is an example of overreaching government micromanagement
we can look forward to if this 2045 Plan is adopted...
In order to enact the 2045 land grab, the County Council must facilitate the adoption of the
new zoning changes. That is what Bill 29 is doing, paving the way to take a large percentage
of AG land from all around the island even though the 2045 GP claims the County want to
promote farming and expand agriculture, it is removing tens of thousands of acres of AG
Land all around the island as seen on the no -longer available "Change Map". Don't believe

me? Go to the map and look at your property. Browse the 2045 Map of the Island and see
what you are planning to do to us residents all over the island. Without due notice.

So, you at the County Council are being used to enact Bill 29 to allow the Director of the
Planning Department to use unverifiable, unreliable and outright erroneous data to remove
resident's land from Agriculture designation because you think we shouldn't get to use our
land anymore. How is it the County has no liability involved with this action, because it
says so right in the plan??? Is anybody liable to make sure the maps are correct before you
take the land? Nobody? How convenient. No legal notice provided to the landowners.
Pretty unconstitutional and unconscionable.
Please do not vote Bill 29 into law.
