SUBJECT: AMENDMENT TO HAWAII COUNTY CODE, CHAPTER 21,
ARTICLE 4, BILLING OF CHARGES; PAYMENT; LATE PENALTY
Attached is a proposed amendment to Chapter 21, Hawaii County Code to make the owner of a
property responsible for the sewer user charges, and include a interest penalty for overdue
penalties.
Currently, the Wastewater Division bills the same customer as the Department of Water Supply.
This has led to situations where the tenant is not responsible for the sewer fees under their lease
but is responsible under the Sewer Code. Another difficult situation arises when the heirs to a
deceased customer do not change the account name. The interest penalty is being added to
account for the time value of the delinquent user fees and to conform more closely with the
Department of Water Supply's penalty provisions.
