COUNTY OF HAWAII <br />ORDINANCE NO. <br />STATE OF HAWAI`I <br />BILL NO. 82 <br />AN ORDINANCE AMENDING CHAPTER 24, ARTICLE 9, OF THE HAWAI`I <br />COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO <br />PEDESTRIANS. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: <br />SECTION 1. Chapter 24, article 9, section 24-249, of the Hawaii County Code 1983 <br />(2016 Edition, as amended) is amended to read as follows: <br />"Section 24-249. [ ] Certain acts by <br />pedestrians prohibited. <br />(a) Pi per-sen shall stand ; a r-aa&way for- the p,�ese-afl No person may enter a <br />roadway, obstruct traffic, or approach moving vehicles for the purpose of: <br />(1) Receiving or soliciting [ ] employment, [of] business, or another good <br />or service from the occupant of any vehicle[..-], unless the vehicle is legally <br />stopped, or <br />(2) Delivering or offering any employment, business, or other good or service to <br />the occupant of any vehicle, unless the vehicle is legally_ stopped. <br />For the purposes of this subsection: <br />"Good or service" does not include aid, assistance, or help provided or <br />rendered in an emergency or traffic accident. <br />(b) The provisions of subsection (a) do not prohibit an individual from: <br />(1) Using sidewalks, areas adjacent to a roadway, an other of the road <br />not ordinarily used for vehicular traffic, provided that the individual does not <br />obstruct traffic or approach moving vehicles; or <br />(2) Holding a sign or engaging in an other ther protected speech activity in a location <br />that does not obstruct traffic. <br />(c) Notwithstanding anything to the contrary, a person convicted of a violation of <br />subsection (a) is subject to: <br />(1) For any violation not within one year of a previous violation: <br />(A) A fine not less than $250 and not more than $1,000; <br />(B) Community service no less than eighteen hours nor more than seventy- <br />one hours; or <br />C Both. <br />(2) For any violation within one year of a previous violation: <br />(A) A fine not less than $500 and not more than $1,000; <br />(B) Community service no less than thirty-six hours nor more than seventh <br />one hours, or <br />C Both. <br />
