SUBJECT: Proposed Amendment to Bill No. 83; An Ordinance Amending Chapter 20 of
the Hawaii County Code 1983 (2016 Edition, As Amended), Relating to
Plastic and Polystyrene Waste.
Transmitted herewith is a proposed amendment to Bill No. 83. The amendment is shown below
in Ramseyer format with respect to the contents of Bill No. 83; material to be deleted is
bracketed and stricken; material to be inserted is underscored.
SECTION 4 of Bill No. 83, which amends chapter 20, article 1, section 20-01-03, of the Hawaii
County Code 1983 (2016 Edition, as amended) by amending a definition of "County facility", is
amended to read as follows:
""County facility" means any propelly, building, structure, or vehicle owned and
operated by the County, its agents, agencies, departments, and franchisees."
SECTION 4 of Bill No. 83, which amends chapter 20, article 1, section 20-01-03, of the Hawaii
County Code 1983 (2016 Edition, as amended) by amending a definition, is further amended to
amend the definition of "County facility users" to read as follows:
""County facility users" means [ ,
person using a Countv facilitv for commercial purposes, including, but not limited to,
concession contracts with the County, County managed concessions, County sponsored
events1 and food services provided at County expense."
Due to the limited scope of this amendment, a copy of the new draft of this bill that would result
if it were adopted is not attached.
