SUBJECT: Proposed Amendment to Bill No. 83; an Ordinance Amending Chapter 20
of the Hawaii County Code 1983 (2016 Edition, as Amended), Relating to
Plastic and Polystyrene Waste.
Transmitted herewith is a proposed amendment to Bill No. 83. The proposed amendment is
shown below in Ramseyer format with respect to the contents of Bill No. 83; material to be
deleted is bracketed and stricken, and material to be inserted is underscored.
SECTION 5 of Bill No. 83, which amends chapter 20, article 5, of the Hawaii County Code
1983 (2016 Edition, as amended), is amended by amending section 20-05-01 to read as follows:
"Section 20-05-01. Prohibition.
[A] Any food provider, [or] County facility user, or organization hosting an event
with County grant funds may not sell, distribute,'use, or otherwise provide to the public:
(1) Disposable foodware made from polystyrene or plastic; or
(2) Disposable serviceware made from polystyrene or plastic, unless requested by
the customer or within a designated self-service area."
Due to the limited scope of this amendment, a copy of the new draft of this bill that would result
if it were adopted is not attached.
