SUBJECT:
Proposed Amendment to Bill No. 83; AN ORDINANCE AMENDING
CHAPTER 20 OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION,
AS AMENDED), RELATING TO PLASTIC AND POLYSTYRENE
WASTE.
Transmitted herewith is a proposed amendment to Bill No. 83. The amendment is shown below
in Ramseyer format with respect to the contents of Bill No. 83; material to be deleted is
bracketed and stricken, and material to be added is underscored.
SECTION 3 of Bill No. 83, which amends chapter 20, article 1, section 20-01-03, of the Hawaii
County Code 1983 (2016 Edition, as amended) by adding definitions, is amended by adding the
following definition to be appropriately inserted and to read as follows:
""Pre -packaged food" means food or drink that is prepared and sealed, contained,
wrapped, or packaged prior to distribution."
SECTION 4 of Bill No. 83, which amends chapter 20, article 1, section 20-01-03, of the Hawaii
County Code 1983 (2016 Edition, as amended) by amending a definition, is amended to amend
the definition of "prepared food" to read as follows:

that is cooked, served, packaged, or otherwise prepared at the request of a customer for
immediate consumption with no heating, cooking, or other preparation required after sale
to be safe for human consumption."
SECTION 5 of Bill No. 83, which amends chapter 20, article 5, of the Hawaii County Code
1983 (2016 Edition, as amended), is amended by amending section 25-05-02 to read as follows:
"Section 20-05-02. Use of reusable or compostable foodware and serviceware
required.
Any food [nr-evider-s afi] provider, business, or County facility user selling,
distributing, or otherwise providing prepared food to the public in disposable foodware or
with disposable serviceware shall do so using foodware or serviceware that is CMA-
certified or visibly labelled as compostable with a BPI certification mark."
SECTION 5 of Bill No. 83, which amends chapter 20, article 5, of the Hawaii County Code
1983 (2016 Edition, as amended), is further amended by amending section 20-05-03, subsection
(a), to read as follows:
"(a) The following are exempt from the provisions of this article:
(1) [Feeds paekaged outside the fiRifts of the County &fHffwaiq-,] Pre -packaged
foods;
(2) Coolers and ice chests that are intended for reuse; and
(3) Food packaging for raw: meat; poultry; seafood; and eggs that have not been
further processed."
Due to the limited scope of this amendment, a copy of the new draft of this bill that would result
if it were adopted is not attached.
