Recess: At 12:15 p.m., the Chair called for a recess. Reconvene: The meeting reconvened at 12:32 p.m. CHR. INABA: I'll call on the author of the resolution, Council Member Villegas. MS. VILLEGAS: Aloha and mahalo, everyone, for being here today. What a powerful and poignant few hours we've just spent. With serendipitous and synchronistic timing, I feel this resolution I'm just humbled and honored to get to play a small part in something so much bigger than myself, so much bigger than even all of us sitting here. So many words have already been said today, and so much truth spoken that I remain hopeful that my colleagues on the Council will continue to vote in the direction that we unanimously voted two weeks ago. Something that came as I was sitting here was, ua mau ke ea o ka `aina i ka pono means the life of the land, and it's perpetuated in righteousness. It's attributed to King Kamehameha III, and it signifies the well-being of the land and its people is maintained through righteous action and integrity. Kamehameha III spoke this on July 31", 1843, when the Hawaiian flag was raised after a brief period of British usurpation of authority. In this context, "ea"was understood as sovereignty, and the motto celebrated the restoration of the kingdom's independence and its rightful governance through righteousness. It was then adopted as the State motto Page 6 Hawaii County Council-22 September 3,2025 in 1959, linking it to modern statehood. That irony doesn't escape me. But I wanted to bring that statement back. Being born and raised here, that was a statement I have always held close to my heart. I would like to humbly urge Governor Green to comply with our State law HRS (Hawai`i Revised Statutes) 343 and the State Constitution Article 11, Section 1, which says, "For the benefit of present and future generations, the State and its political subdivisions shall conserve and protect Hawai`i's natural beauty and all natural resources, including land, water, air, minerals and energy sources . . . . All public natural resources are held in trust by the State for the benefit of the"public. This article clearly states "the State and its political subdivisions." This means the County government. We as County Council Members are equally responsible, which is why this vote and this resolution being heard by the Hawaii County Council is relevant and holds great significance both legally and as an overall statement. So I am there's lots more I can say, but I am hopeful that our Council will continue to make decisions today in alignment with the decisions that were made two weeks ago. Ua mau ke ea o ka `aina i ka pono. I yield. CHR. INABA: Council Member Kierkiewicz. MS. KIERKIEWICZ: Thank you, Chair. Mahalo nui everyone for being here today, for taking time off of work, all the `opio that were away from school and just being away from your `ohana and spending your morning, and now afternoon, with us. Like Council Member Villegas said, it was I think a really powerful moment to see all of these collective voices here together, thinking about the kind of future that we want for ourselves and for future generations. And when I reflect on what many of the testifiers were saying, from keiki to kupuna, the kind of vision we want here in the islands is one rooted in peace, one where our `aina is healthy, our families are thriving, and there is abundance not just for a few but for all. This morning, like every morning when I take my daughter to school, we talk about what's ahead for the day. And she was sharing with me about the poster she was working on in science class about the Big Bang Theory. And she knew it was a Council day because we wear jackets on days that we make laws. She's like "Mom, what are you guys discussing?" So I told her about this resolution. And I told her about Committee and how it brought out so many members of community, in person, written testimony, over Zoom, really all over the State. And I explained to her about the ongoing lease negotiations and what was happening on Pohakuloa, and how the DLNR (Department of Land and Natural Resources) rejected the military's EIS (Environmental Impact Statement). And she couldn't understand that the military could just have so much power here. She couldn't understand that they could continue to harm people and place, and felt kind of at a loss of words that there was no accountability. Page 7 Hawaii County Council-22 September 3,2025 Right now in eighth grade, they're learning about checks and balances. And for the life of her, she just couldn't see any of that happening; and for a 13 year old to be so perceptive and to recognize imbalance and injustice. So I want to thank you, Council Member Villegas, for bringing forth this resolution. It's not just about asking the military to acknowledge the hurt and the harm done. It's about demanding action. It sends a very clear message that we will not continue to accept the status quo, and that the community will not quietly bear the burden of decisions made far away by those who don't even live here to bear the consequences. So I appreciate the opportunity to affirm our kuleana to continue to support and protect our community. I yield. CHR. INABA: Council Member Galimba. MS. GALIMBA: Thank you. I'm in favor of this resolution. I will be voting in favor of it, but I'm somewhat of a contrarian. So I just feel that I need to, No. 1- oh, there's no question that the military needs to do better. They've done terrible things at Pohakuloa, as well as in their history as athey've been excessive, have excessive influences around the world. But I also wanted to thank the folks that came here in opposition to this resolution, because I think there is another side to this that has not been voiced, except for a few testifiers. And that is that we do live in a republic and a democracy, and I don't take that for granted. And we are very fortunate, I think, to live in this republic and this democracy. And there's things that have happened in the past, World War II for instance; a lot of bad things happened in the name of a good thing. Pohakuloa is a very small piece of a very turbulent time that we are in. But I think it also is a significant part of global balance of power right now. I think we need to take that into account and maybe give Governor Green a little bit of, I don't know what the right word is, but understand that he is in a very difficult position in wanting to protect this State under this administration in this world. So I just wanted to voice that, because I think we live in a world that is not so good and wonderful as we would like it to be. And sometimes, we have to acknowledge that, and that things might not be exactly as we want them to be. But we can definitely say that we don't want bombing and desecration activities to happen at Pohakuloa. So that's just what I wanted to say. CHR. INABA: Council Member Kagiwada. MS. KAGIWADA: Thank you, Chair. I guess I'm just going to reiterate a couple of the things I said previously on this resolution. To me, there's something very much not right when the military has promised things like cleaning up the unexploded ordnances on our DHHL (Department of Hawaiian Home Lands) lands; they're still not doing it. It's like if you wanted to get in a good position, if you really care and you say this is the most important, you know, it's such an Page 8 Hawaii County Council-22 September 3,2025 important place for the military, why wouldn't you start doing what you've already promised to do? Why don't we see that activity happening right now? Even if it was for the reason of you just—not because you wanted to do good, but because you wanted to get in a good place to negotiate. And I just feel like if they're not even willing to do that, what they've already said they would do, how do we believe going forward any other promises that they might make? So, to me, the first step is fulfill the promises you've already made before you come and talk to us. I guess that's all I mainly want to say now. I yield. CHR. INABA: Council Member Kimball. MS. KIMBALL: Thank you. First of all,just want to acknowledge everybody coming out today, especially all the keiki. Just so wonderful to see the next generation actively involved in local-level politics. I mean, thisI think I speak for all of us when it's like,yay, there are folks that are going to take up the mantle next that are passionate and informed and willing to come and speak out. I am also going to support this resolution today. I think it is important, as was said, that the wrongs be recognized, the work that needs to be done is actually done. There is accountability. What I will say is, a couple of years ago, I attended a climate change conference; ironically, a climate change conference hosted by the Department of Defense. One now (inaudible)there has actually been no other agency within the Federal Government that has been more advanced on climate change, because they're trying to protect their assets, right. But I raise this because one of the speakers at this conference was DLNR Chair Chang. And she didn't actually speak; she played a video to Braddah Iz. She played a video of all the pictures of all of the protests at DoD (United States Department of Defense) sites across the State of Hawaii. And as she played it, there was not a single dry eye in that room from anybody in there. And her message at that time—and again, this was a couple of years ago—was "Look ! If you guys still want to maintain a presence in Hawaii, do better. Understand that you have broken promises, broken trusts in this community. This is what it looks like. And if you want to stay here, if you want to keep working with us, do better." Additionally, the last several years we've had, when we've been in Washington, listening sessions with DoD to speak specifically about the DoD's presence in Hawaii. And every time we have given them the message "Do better. Keep your promises. Clean up. Stop the live fire." So it's not like this resolution comes without DoD having a sense like "We've been telling you guys." This is not going to be news by any means. But I think it is an important reinforcement of what the expectations are from this community. Page 9 Hawaii County Council-22 September 3,2025 I will conclude,just similarly to Council Member Galimba, I am a pacifist at heart. I wish there was never any global conflict; there was no war, there was no murder. I would love to see that. Unfortunately, that is not the reality that we're in. So I just want to mention there are nuances, and one of the key ones is that the young men and women who often become armed personnel within our military are often the poor black and brown folks that cannot get a college education, buy a home, get a career any other way. And so if there is a situation where the military determines that they will be best trained by being in a particular place and having a particular kind of training, that colonel has to be in there to think about also protecting the lives of these young folks. I only raise this to say there's not like a blanket one-size-fits-all thing. There are places where there's global conflict, where there are women, children. We do have a, I know it's an oxymoron, peacekeeping role. I'm supporting a future resolution here, the peace day parade in Honoka`a, because I genuinely believe that peace is the goal. Global peace is the goal. We are not there but we do need to think about our relationship with the military in this State. And I think that this resolution creates the opening for that conversation, as clearly demonstrated today. CHR. INABA: Any further discussion? Seeing none, during today's testimony I was looking back through the Ku`e Petitions from 1897 and the 38,000 signatures that were collected across the pae `aina. Finding again my own family's names from Puna back at that time, and look we're still here. So I want to mahalo everyone who came out to testify. I'm happy that this Council can make a statement on behalf of this County on this specific resolution. So thank you, Council Member Vilegas, for introducing this resolution and giving not only the Council an opportunity to speak, but members of this community and members of the greater pae `aina. Just in regards to that, back when I was on the Council, we did pass a resolution for County departments not to use glyphosate. And so they have not been using that. And to my knowledge, they're still not doing it. And that's when we talked about how to do the maintenance. So a lot of times it was within they had to weed whack or they had to do other alternatives to control the weeds. So just to let you folks know that. And down at the different ponds down in Keaukaha, they are also not spraying poison. And they're having the nonprofits taking care of those areas. So just asking for your guys' support and to confirm that they're not being sprayed by poison, right. Thank you. CHR. INABA: Thank you, Vice Chair Onishi. We've had some good conversation about this and appreciate the opportunity to provide tax relief. Chair Inaba and I brought a bill forward providing tax relief for a specific part of our communities. And this is also providing something similar to another part of our communities that have infrastructure that are in poor state. So I do recognize the effort being made here. Page 33 Hawaii County Council-22 September 3,2025 I did have a question. Administrator Miura, if you're there, maybe you could maybe in your conversations with Council Member Kaneali`i-Kleinfelder, he shared this with you. If not,please let me know. And this is really the end goal and the intent of this bill, in terms of that it's providing an opportunity for improvement in these community areas, particularly the roads that have been poorly maintained, managed, whatnot. And I don't know if he shared with you that the goal would be that monies would be provided to these road maintenance organizations or HOAs (homeowners associations). They would then in turn improve those roads, having potentially a little bit more funds to do so, with the roads that would then be improved to a state where they are turned over to the County. Did the Council Member share that with you at all? (Note: At this time, Real Property Tax Administrator Lisa Miura, Finance Department, came forward to address the members of the Council.) MS. MIURA: Good afternoon, Real Property Tax Administrator Lisa Miura. That, to my knowledge, was not ever brought up as one of the goals. MR. HUSTACE: Okay. I'm just looking for kind of this long-term vision of what the bill intends. Otherwise, it's providing relief in perpetuity, which I understand if those roads need improvement in a private state for a long time, I understand that. I still believe that there are mechanisms within the road maintenance organizations and HOAs that can be utilized for the purpose of collecting more fees or making those fees mandatory. So we've had some of those conversations. Some have testified saying, "Oh, our fees are $25." "Our fees are $50." I know that's not going to cover a lot of road maintenance, so fees probably need to be increased. Road costs are expensive. And then of course, if those fees are optional, then the work's not going to be done. So some other mechanism needs to be put in place for those HOAs. And that's just my personal view. I know I'm the lone "no"voter on this one, but I still see that there are mechanisms within those HOAs to kind of get those wheels moving to improve. And I hear you on the roads that are in terrible condition. And if there's challenges with getting emergency vehicles there, that's a big problem. But if those HOAs and those private organizations are not moving to get that stuff, that's definitely a burden for sure. And it puts out a lot of our emergency response efforts. So I definitely still have some challenges with this. So I'll just leave it at that. It's unfortunate the member who introduced this is not here. So I welcome any other thoughts on this discussion. Thank you, Chair. CHR. INABA: All right, Vice Chair Onishi and then Council Member Galimba. MR. ONISHL Thank you, Chair. I kind of echo what Council Member Hustace is mentioning. Because after listening to this morning's testimony from the one Page 34 Hawaii County Council-22 September 3,2025 gentleman, he mentioned I think it was like a volunteer to I guess pay for the roadway fee. And so now, then the burden comes onto the County where they should do a correction on that part first with the association before we can help with compensation. So I kind of feel the same way. And I don't know maybe if we should postpone this until the author comes back, right. And then that way we can have that better discussion and get more details about our concerns. I think I personally might want to have a sunset date on it, so that can be more of a pilot project so that we could see if it works or not. If it works, then extend it. And if it doesn't help, then we can sunset it. I don't know what Administrator Miura feels about putting things on and then taking them off, but perhaps you could discuss that. I was thinking maybe five years or something, so that gives it a little run time. But at least we would be able to see if it is working. We'd have a point in time to see if it's working or not. Administrator Miura, what's your thoughts on that? MS. MIURA: No thoughts really. I think it would be up to the maker of the bill to justify whether it should be just for five years. I can understand wanting to review certain bills. I mean, there's others that have been passed before that we wish there was some mandatory review period to make sure it did what it was intended to do. But I don't have any direct thoughts on this one. MS. GALIMBA: Thank you so much. Yeah, I think I'd be in favor, definitely, of postponing so we can continue the discussion. CHR. DARROW: Good afternoon, Chair Inaba, Vice Chair, and members of the Hawaii County Council. MR. ONISHL I just want you to kind of just give a brief of this whole bill to let the public understand again, because I think it's been a while. People are going to forget and had so much changes. So I just want a simple explanation. MR. DARROW: No problem. MR. ONISHL Thank you very much. MR. DARROW: Jeff Darrow with the Planning Department. Going back some time, this has been several years now, this was initiated as a result of our typical process. And that is, when we receive a complaint for activity that in our code is not permitted in a particular zoning district without maybe a use permit or a special permit or even if just not permitted, we'll receive a complaint. We'll have a zoning inspector go out and investigate. And if they find that in fact it is a violation, they will initiate a notice of violation. In this particular case, it was a Chabad, which is a type of Jewish synagogue, my understanding. And they were operating in a residential zoning district without a use permit. So they had the ability to get a use permit to be permitted, but in working with them to go through the process, they felt it was cumbersome. They felt, in looking at it and getting advice, that it actually was unconstitutional in the sense that other similar types of facilities in our code were allowed or allowed through plan approval but didn't require a use permit. So we were challenged on that. So we had to take a really good look at our Zoning Code, work with the different parties involved, and be able to come up with a resolution which I really can't say enough. I appreciate all the help from Council Member Kierkiewicz and all of the Council Members going through this process, as well as staff and the different members of the public that helped us in being able to come to this final adoption of this bill. It basically results in a combination of different types of uses, whether it be a community building, a meeting facility, or different types of places of worship all combined in what's called a meeting facility. And those are pretty much permitted throughout all districts, except we don't have any control over the State Land Use Agricultural District, which requires a special permit. And if it's in the Page 37 Hawaii County Council-22 September 3,2025 County ag, it would require a use permit. So those are the only differences. But again, we don't have now similar types of uses. They were all combined into one. So whatever process, it's all the same for that particular use. Additionally, as we had spoken about throughout the process, we were also trying to find that balance of special events and how they corelate with these meeting facilities or maybe separate. But we were able to also combine that in this bill, which resolved a lot of things for the Planning Department. MR. ONISHL And just to reassure those that are in existence about the hours. MR. DARROW: Yes, those were deleted. MR. ONISHL Yeah. So now, it's not a limited time, but we've made it how in the past was, right? MR. DARROW: Correct. MR. ONISHL Okay, good. HUSTACE: Thank you, Chair. I appreciate the time. This weekend, a number of events going on in the Waikoloa community. One is the HI-PAL (Hawai`i Isle Police Activities League) event, so I intend to see Council Member Onishi there. No, but the one I wanted to point out is actually the Pu`u Nui Playground blessing. The Mayor sent out an update about this from Administration and Parks and Rec (Recreation)reopening this space. This has been a long time coming for the community, and a lot of the equipment has been sitting in the storage unit on site for two years. So, grateful for the community volunteers to really reactivate that space; get in there, get their hands dirty, and work with the contractor to reopen that space. I don't know if Council Member Onishi wanted to announce this, but I'll just say of course everybody's invited to the Queen's birthday patty at Queen Lili`uokalani Park this Saturday, from 10 (a.m.) to 3 (p.m.). Hopefully, everybody's going to be there. And then I just saw something that I thought was cool I wanted to announce. Apparently, there's a training opportunity at `Imiloa on September 12 from 9 (a.m.) to 3 (p.m.). This is for people to learn about working with LGBTQ (lesbian, gay, bisexual, transgender and queer) community members, along with cultural issues. So it sounds really interesting. It's being offered through the Office of the Prosecuting Attorney's office. So I just wanted to let people know about that as well. Thank you. CHR. INABA: Thank you. The county councils are meeting next week for the Hawaii State Association of Counties conference being held September 10"' through the 12th at the Westin Hdpuna.
