SUBJECT: Proposed Amendment to Bill No. 63; an Ordinance Amending Chapter 25, Article
5, of the Hawaii County Code 1983 (2016 Edition, as Amended), Relating to
Dwellings.
Transmitted herewith is a proposed amendment to Bill No. 63.
The proposed amendment is shown below in Ramseyer format with respect to the contents of the
Hawaii County Code 1983 (2016 Edition, as amended) as herein provided; material to be deleted
is bracketed and stricken, and material to be added is underscored.
1. Bill No. 63 is amended by adding a section to be appropriately inserted as SECTION 3
and to amend chapter 25, article 5, section 25-5-138 of the Hawaii County Code 1983 (2016
edition, as amended), to read as follows:
"Section 25-5-138. Other regulations.
(a) Plan approval shall be required for all new structures and additions to existing
structures in the MCX district.
(b) Any dwelline within the MCX district shall have a minimum setback of two
hundred feet from the nronerty boundary adioining any MG (general industrial)
district which may be increased when required by the director.
[(b)] (c) Exceptions to the regulations for the MCX district regarding heights,
building site areas, building site average widths and yards, may be approved by the
commission within a planned unit development."

2. SECTIONS 3, 4, and 5 of Bill No. 63 are renumbered as SECTIONS 4, 5, and 6,
respectively.
Due to the limited scope of this proposed amendment, a copy of the new draft of this bill that
would result if this amendment were adopted is not attached.
