SUBJECT: Proposed Amendment to Bill No. 83, Draft 2; AN ORDINANCE AMENDING
CHAPTER 20 OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION, AS
AMENDED), RELATING TO PLASTIC AND POLYSTYRENE WASTE
Transmitted herewith is a proposed amendment to Bill No. 83, Draft 2. The proposed
amendment is shown below in Ramseyer format with respect to the contents of Bill No. 83;
material to be deleted is bracketed and stricken, and material to be inserted is underscored.
SECTION 5 of Bill No. 83, Draft 2, which amends chapter 20, article 5, of the Hawaii County
Code 1983 (2016 Edition, as amended), is amended by amending section 20-05-03(a) to read as
follows:
"(a) The following are exempt from the provisions of this article:
(1) Pre -packaged foods;
(2) Coolers and ice chests that are intended for reuse; [and]
(3) Food packaging for raw: meat; poultry; seafood; and eggs that have not been
further processed[...]-, and
(4) An food ood provider with ten or fewer employees, provided that this exemption
shall expire on January 1, 203 L"
Due to the limited scope of this amendment, a copy of the new draft of this bill that would result
if this proposed amendment were to be adopted is not attached.
