SUBJECT: Proposed Amendment to Bill No. 83, Draft 2; An Ordinance Amending Chapter
20 of the Hawaii County Code 1983 (2016 Edition, as Amended), Relating to
Plastic and Polystyrene Waste
Transmitted herewith is a proposed amendment to Bill No. 83, Draft 2.
The proposed amendment is shown below in Ramseyer format with respect to the contents of
Bill 83, Draft 2; material to be deleted is bracketed and stricken, and material to be inserted is
underscored.
SECTION 5 of Bill No. 83, Draft 2, which amends chapter 20, article 5, of the Hawaii County
Code 1983 (2016 Edition, as amended), is amended by amending section 20-05-03(a) to read as
follows:
"(a) The following are exempt from the provisions of this article:
(1) Pre -packaged foods;
(2) Coolers and ice chests that are intended for reuse; [and]
(3) Food packaging for raw: meat; poultry; seafood; and eggs that have not been
further processedH, and
(4) Any food provider with ten or fewer employees provided that this exemption
shall expire on January 1, 2028."
Due to the limited scope of this amendment, a copy of the new draft of this bill that would result
if this proposed amendment were adopted is not attached.
