SUBJECT: Proposed Amendment to Bill No. 83, Draft 2; AN ORDINANCE AMENDING
CHAPTER 20 OF THE HAWAI'I COUNTY CODE 1983 (2016 EDITION, AS
AMENDED), RELATING TO PLASTIC AND POLYSTYRENE WASTE.
Transmitted herewith is a proposed amendment to Bill No. 83, Draft 2. The proposed
amendment is shown below in Ramseyer format with respect to the contents of Bill 83, Draft 2;
material to be deleted is bracketed and stricken, and material to be inserted is underscored.
SECTION 3 of Bill No. 83, Draft 2, which amends chapter 20, article 1, section 20-01-03, of the
Hawai'i County Code 1983 (2016 Edition, as amended) by adding definitions, is amended by
deleting the definitions for "BPI certification mark" and "CMA-certified."

SECTION 5 of Bill No. 83, Draft 2, which amends chapter 20, article 5, of the Hawai'i County
Code 1983 (2016 Edition, as amended), is amended by amending section 20-05-02 to read as
follows:
"Section 20-05-02. Use of reusable or compostable foodware and serviceware
required.

Any food provider, business, or County facility user selling, distributing, or
otherwise providing prepared food to the public shall do using disposable foodware or
with disposable serviceware that is visibly labeled as eaffipestabi

Standards D6400 D6868 or D8410, or any other equivalent technical standard for
compostability or biodegradability, or foodware or serviceware that is reusable."
Due to the limited scope of this amendment, a copy of the new draft of this bill that would result
if this proposed amendment were adopted is not attached.
