Where is the definition for"public" and "carton?"
Isn't "polystyrene" a type of "plastic?" Why the differentiation?
What exactly does "provide to the public" mean? Does it mean to family members?
Friends? Social group? Co-workers?
Hypothetical: Let's say you're having a picnic at a County park with your family. If you serve
food on plastic disposable foodware with disposable serviceware are you in violation
because you are "providing food to the public?" What if someone brings a friend who is a
stranger to you, is that "friend" someone from the "public" and therefore you can get fined
for giving them food on/in plastic disposable foodware? What if you have an office partyfor
co-workers and a client or acquaintance happens to stop by, can you ofPerthem food on
plastic disposable foodware or will you get fined? Can you give a houseless person food in
plastic foodware and not be fined?
Does this mean that someone from DEM will be personally policing private individuals or
social groups at County facilities for compliance and issuing fines?
New §20-05-01(2) seems to directly contradict new 920-05-02 serviceware prohibition.
One says if requested or provided in self-service area it is allowed and the other says it isn't
allowed.
This bill seems to make it illegal for grocery stores, convenience stores or etc. with a deli
section setting prepared food for immediate consumption to also sell disposable plastic
foodware or serviceware. Meanwhile stores (including online) without deli sections can
still sett disposable plastic foodware or serviceware.
