HomeMy WebLinkAboutORD 2025-090 2024-2025YOf ,t COUNTY OF HAWAPI STATE OF HAWAPI ARE Of'N�•� BILL NO. 89 ORDINANCE NO, AN ORDINANCE AMENDING CHAPTER 7, ARTICLE 1, OF THE HAWAVI COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO THE APPOINTMENT OF THE CIVIL DEFENSE ADMINISTRATOR. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: SECTION 1. Chapter 7, article 1, section 7-1-2, of the Hawaii County Code 1983 (2016 Edition, as amended) is amended to read as follows: "Section 7-1-2. Agency organization[, appointut j. The civil defense agency shall perform emergency management functions pursuant to chapter 127A and chapter 128A of the Hawaii Revised Statutes and shall consist of the following: (1) The head of the civil defense agency, who shall be the mayor of the County. (2) A full-time civil defense administrator, who shall be responsible for administrative functions and emergency management operations during non - emergency periods and, within the delegated scope of authority, have all the duties and responsibilities of the mayor during declared emergencies. [The administr-ator shall be hired aeeafding to !he provisions of ehapter 76 of 14 :'; n o sod Sia4„teRd (3) Sufficient staff to carry out the duties and functions of the agency. (d) The employees and resources of all County departments, agencies, and offices in emergency management activities as needed. (5) Non -governmental organizations offering emergency management services pursuant to an agreement with the County, or accepted by the County when no agreement exists." SECTION 2. Chapter 7, article 1, of the Hawaii County Code 1983 (2016 Edition, as amended) is amended by adding a new section to read as follows: "Section 7-1-3. Civil defense administrator; appointment, qualifications. (a) The civil defense administrator shall have a minimum of three years of responsible administrative experience in emergency management, disaster planning, homeland omeland securi1y. or public safety services management, (b) The civil defense administrator shall be appointed by the mayor and may be removed by the mayor in accordance with chapter 76 of the Hawai` -Revised Statutes. c In the event of a vacancy, the mayor may convene a selection advisory panel consisting of the fire chief and chief of police to evaluate qualified applicants. The mayor shall appoint an administrator within sixty days of the position becoming vacant." SECTION 3. Chapter 7, article 1, of the Hawaii County Code 1983 (2016 Edition, as amended) is further amended by renumbering sections 7-1-3 through 7-1-6, inclusive, as sections 7-1-4 through 7-1-7, respectively. SECTION 4. Material to be repealed is bracketed and stricken. New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material, and underscoring need not be included. SECTION S. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 6.
