councilmember Jennifer Kagiwada:
I am writing to express support for Resolution 320-25. Much of the
resolution is (or should be) a truism, repeating and reminding us of
already -established rights in the state and federal Constitution. And
yet, recent events nationwide and even in Hawaii (Maui) have horrified
me because in increasing numbers of cases, due process and
protection from unreasonable searches and seizures have NOT been
afforded to immigrants and US citizens.
I am so very grateful to have been welcomed into this community for
the past 26 years and to be protected by the spirit of aloha and
'ohana. I would Like to trust that our own police would continue to
protect our entire community. Therefore I support this resolution's
requests that (1) the mayor review all current and future agreements
and memoranda (having to do with enforcement) to ensure that
constitutional rights are protected, and (2) the Hawaii Police
Department confine its involvement with the US Dept. Homeland
Security Immigration and Customs Enforcement (ICE) to cases
involving criminal activity. (I would clarify the language of the
resolution to restrict the definition of "criminal" activity to NOT
include violations of immigration law that were previously considered
civil rather than criminal; please do not cooperate with the federal
redefinition and expansion of "criminal" in this regard.)
