i <br />COUNTY OF HAWAI`I STATE OF HAWAI`I <br />;•;thy.; <br />BILL NO. 127 <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 5 OF THE HAWAI°I COUNTY CODE 1983 <br />(2016 EDITION, AS AMENDED), RELATING TO THE ESTABLISHMENT OF A <br />CONSTRUCTION CODE COMMISSION. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAP°I: <br />SECTION 1. Chapter 5 of the Hawaii County Code 1983 (2016 Edition, as amended) is <br />amended by adding an article to be appropriately designated and to read as follows: <br />"Article . Construction Code Commission. <br />Section 5-_-_ Commission established. <br />(a) There shall be a construction code commission consisting of seven members, <br />subject to and appointed in accordance with section 13-4 of the Charter. Members <br />shall possess substantial experience or expertise in construction or a related field, <br />including, but not limited to, architecture, engineering, electrical work, plumbing, <br />fire protection, building material supply, construction management, trade <br />representation, general contracting, or self -contracting as a homeowner -builder. <br />(b) The director of public works, the planning director, the fire chief, and the manager - <br />chief engineer of the department of water supply, or their designated <br />representatives, shall serve as ex-officio members of the construction code <br />commission without power to vote. <br />Section 5-_-_ Powers and duties. <br />The construction code commission shall: <br />(1) Advise the mayor, the council, and the director on matters relating to the <br />construction code pursuant to law; <br />(2) Review and evaluate updates to the Hawaii state building codes as set forth in <br />the Hawaii Revised Statutes, section 107-25, except for the Hawaii state fire <br />code; <br />(3) Recommend amendments to the construction code; and <br />(4) Review technical guidance, policies, and interpretations made by the director <br />relating to the construction code." <br />SECTION 2. Severability. If any provision of this ordinance, or the application thereof <br />to any person or circumstance, is held invalid, the invalidity does not affect other provisions or <br />applications of the ordinance which can be given effect without the invalid provision or <br />application, and to this end the provisions of this ordinance are severable. <br />
