HomeMy WebLinkAboutRES 461 Draft 01 2024-2026A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF LATER FISCAL YEARS TO ENTER INTO A MULTI-YEAR AGREEMENT FOR PROFESSIONAL CONSTRUCTION MANAGEMENT SERVICES RELATING TO THE HILO WASTEWATER
TREATMENT PLANT UPGRADE PROJECT TO BE USED BY THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT.
WHEREAS, Section 10-11 of the Charter of the County of Hawaiʻi (hereinafter, “the Charter”) provides, in part, that “any contract, lease or other obligation requiring the payment of
funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made or approved by resolution”; and
WHEREAS, the Department of Environmental Management wishes to enter a multi-year agreement with a term of six years for professional construction management services relating to the
Hilo Wastewater Treatment Plant Upgrade Project (hereinafter, “the Project”); and
WHEREAS, the Hilo Wastewater Treatment Plant is a critical piece of County infrastructure that requires essential upgrades to ensure long-term operational reliability and environmental
compliance; and
WHEREAS, the funds will be used to retain professional construction management services, including on-site inspection, quality assurance, project scheduling, and contract administration
to ensure the facility is upgraded in compliance with environmental regulations and technical requirements; and
WHEREAS, given the complexity and scale of the construction phase, the Project is anticipated to span multiple fiscal years; and
WHEREAS, securing a multi-year management contract is necessary to provide continuity of oversight, mitigate project risks, and ensure that the County’s interests are protected throughout
the duration of the Project; and
WHEREAS, the Department of Environmental Management estimates that the annual cost of this agreement will be $1,600,000; now, therefore
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that the Mayor is hereby authorized to enter into a multi-year agreement with a term of six years for the purposes hereinabove
described.
BE IT FURTHER RESOLVED that, in accordance with Section 10-11 of the Charter, sufficient funds be budgeted in later fiscal years to cover the anticipated obligations of the County under
the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to Daniel Girvan, Director of Environmental Management; and Diane T. Nakagawa, Director of Finance.
