HomeMy WebLinkAboutRES 460 Draft 01 2024-2026A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF LATER FISCAL YEARS TO ENTER INTO A MULTI-YEAR LEASE AGREEMENT FOR REAL PROPERTY TO BE USED BY THE OFFICE OF THE CORPORATION COUNSEL. WHEREAS, Section 10-11 of the Charter of the County of Hawai‘i (hereinafter “the Charter”) provides, in part, that “any contract, lease or other obligation requiring the payment of funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made or approved by resolution”; and WHEREAS, the Office of the Corporation Counsel (hereinafter “the Lessee”) wishes to enter into a multi-year lease agreement with Joy A. San Buenaventura, Attorney at Law, A Law Corporation (hereinafter “the Landlord”), with a term of three years commencing on or about April 1, 2026, and not to exceed December 31, 2029, with two options to extend the lease for an additional three years at a rate to be negotiated at that time; and WHEREAS, the Lessee estimates the monthly cost of this agreement to be $2,600.00, plus an additional charge to pay the Hawai‘i general excise tax, which is currently 4.4386%; and WHEREAS, services covered in the negotiated lease shall include, but are not limited to electricity, water, trash removal for common areas, and dumpsters for tenant use; and WHEREAS, having additional office space is necessary for added personnel filling open position vacancies within the Office of the Corporation Counsel; and WHEREAS, the two units to be leased under this proposed agreement are identified as Apartment Nos. 311 and 312, each containing approximately six hundred square feet of office space and located at 101 Aupuni Street, Hilo, Hawai‘i 96720; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that the Mayor is hereby authorized to enter into a multi-year lease agreement with the Landlord for a term of three years, with two three-year lease extension options, for the purposes hereinabove described. BE IT FURTHER RESOLVED that, in accordance with Section 10-11 of the Charter, sufficient funds be budgeted in later fiscal years to cover the anticipated obligations of the County under the terms of the lease agreement. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable C. Kimo Alameda, Mayor of the County of Hawai‘i; Diane T. Nakagawa, Director of Finance; Renee N. C. Schoen, Corporation Counsel; and Joy A. San Buenaventura, Attorney at Law, A Law Corporation, HC 3 Box 13579, Kea‘au, Hawai‘i 96749.
