REPORT OF THE <br />LEGISLATIVE APPROVALS AND ACQUISITIONS COMMITTEE <br />DATE: January 22, 2026 <br />PLACE: Council Chambers <br />Kailua-Kona, Hawaii <br />TIME: 10:43 a.m. <br />Council Chair and Members <br />Hawaii County Council <br />Hilo, Hawaii 96720 <br />Re: Comm. No. 688/Bill No. 120 <br />Your Committee on Legislative Approvals and Acquisitions, to which was referred Bill No. 120, <br />reports as follows: <br />Bill No. 120, transmitted by Managing Director William V. Brilhante, Jr., via Communication <br />No. 688, dated December 29, 2025, amends Ordinance No. 04-149, as amended, which reclassified <br />lands from Agricultural — Five Acres (A-5a) to Single -Family Residential — 20,000 square feet <br />(RS-20) at Kalaoa I" and 2nd, North Kona, Hawaii, covered by Tax Map Key: 7-3-011:068 <br />(Applicant: Ernest and Elizabeth Young) (Area: 1.86 acres). <br />The Leeward Planning Commission forwards its favorable recommendation for the requested <br />deletion of Condition H, which prohibits construction of a second dwelling unit on the property, <br />and to amend Condition C for a five-year time extension to secure final subdivision approval. The <br />property is located at the southwest comer of the intersection of Mahilani Drive and Mamalahoa <br />Highway. <br />Planning Director Jeffrey Darrow and Applicants Ernest and Elizabeth Young were present in <br />Chambers. <br />Mr. Darrow provided a PowerPoint presentation regarding Bill 120 via Communication 688.1. <br />Committee Member Holeka Goro Inaba requested confirmation of structures currently on the <br />southern and northern portions of the -property. Mr. Young stated there is one four -bedroom, two - <br />bathroom dwelling and one `ohana unit on the southern property. Mr. Inaba asked if the `ohana unit <br />was intended to be a main dwelling for one of the lots. Ms. Young replied that if allowed to <br />subdivide the property, the intent of the `ohana unit is either for a main dwelling or an Additional <br />Dwelling Unit (ADU), with the northern portion for another unit. Mr. Inaba noted that the property <br />is in his district and that any concerns are provided and addressed as it is a corner lot with safety <br />issues. Mr. Inaba closed by sharing that he does support the extension and requested the applicants to <br />act quickly by working with the specific departments. <br />Committee Member James E. Hustace inquired about a geometrical shape shown on the site plan at <br />the third parcel. Ms. Young replied that it is an existing driveway; however, if able to move forward <br />with subdivision that driveway would be removed as currently there is access from both sides. <br />Mr. Hustace clarified that the geometrical shape shown is a current access, but State Highways <br />recommends the closure of that particular access. <br />LAAC Report No. 28 <br />
