RESOLUTION NO. �69 "I
A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF PUBLIC
WORKS TO ISSUE A LICENSE FOR ENTRY, LANDSCAPING, AND MAINTENANCE
OF A PORTION OF A RIGHT-OF-WAY OWNED BY THE COUNTY.
WHEREAS, Section 2-119(b) of the Hawaii County Code 1983 (2016 Edition, as
amended) (hereinafter the "Code") provides that the Council "may, after consulting with the
chief of police, direct the director of public works to issue licenses and permits through
negotiation and without public auction to enter and occupy public highways and other rights -of -
way owned, maintained and/or under the jurisdiction of the County, subject, however, to such
restrictions, conditions and terms which will best serve the interests of the County and the
general public"; and
WHEREAS, the Department of Public Works wishes to grant Kuakini Makai
Association, Inc., a Hawaii nonprofit homeowners' association, a revocable license to enter
upon, landscape, and maintain a portion of a right-of-way owned by the County, as depicted on
Exhibit A, attached hereto and incorporated herein by reference; and
WHEREAS, the portion of the County right-of-way in question, identified by Tax Map
Key No. (3) 7-6-024:999, situated in the District of Kona, is located on the southern side of
Kuakini Highway, to the east of Keakealani Drive, and measures approximately 218 feet long by
18 feet wide; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI'I that,
pursuant to Section 2-119(b) of the Code, the Director of Public Works is hereby authorized and
directed to issue a license for the purposes hereinabove described, subject to such restrictions,
conditions and terms which will best serve the interests of the County and the general public.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to Diane T. Nakagawa, Director of Finance; Wesley R. Segawa, Director of Public
Works; and Kuakim Makai Association, Inc., P.O. Box 2924, Kailua-Kona, HI 96745.

NOTES ON DIAGRAM
1. Portion of ROW area labeled as "Al" (approximately 218' X 18' of grass/weeds along Kuakini Highway) to be partially dryscaped by KMA.
2. Existing shrubs (plumbago and bougainvillea) and groundtover (wedelia and agave -type plants) along/on top of rockwall ROW line (adjacent to
dryscaped area) to remain and be maintained by KMA.
3. Plumeria trees (PT) PT1 and PT2 have been removed by KMA to ground level due to County tine -of -sight issues. PTs 3, 4 and 5 to remain and be
