HomeMy WebLinkAboutBIL 127 Draft 03 2024-2026 AN ORDINANCE AMENDING CHAPTER 5 OF THE HAWAIʻI COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO THE ESTABLISHMENT OF A CONSTRUCTION CODE COMMISSION. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I: SECTION 1. Chapter 5 of the Hawaiʻi County Code 1983 (2016 Edition, as amended) is amended by adding an article to be appropriately designated and to read as follows: “Article . Construction Code Commission. Section 5- - . General provisions. (a) There shall be a construction code commission consisting of seven members, subject to and appointed in accordance with section 13-4 of the Charter. Members shall possess licensure or substantial experience or expertise in construction or a related field, including, but not limited to, architecture, engineering, electrical work, plumbing, fire protection, building materials, homeowners insurance, construction management, trade representation, general contracting, or self-contracting as a homeowner-builder. (b) The director of public works, the planning director, the fire chief, and the manager-chief engineer of the department of water supply, or their designated representatives, shall serve as ex-officio members of the construction code commission without power to vote. (c) The director of public works shall provide clerical and administrative support to the commission necessary for the performance of its duties. (d) When transmitting any proposed amendment to the construction code, including the adoption of new construction codes, to the Council for its consideration, the director shall also transmit any recommendations and comments from the commission on the proposed amendment. Section 5- - . Powers and duties. The construction code commission shall have the power to: (1) Advise the mayor, the council, and the director on matters relating to the construction code pursuant to law; (2) Review and evaluate updates to the Hawaiʻi state building codes, except for the Hawaiʻi state fire code, that are being considered by the State building code council pursuant to the Hawaiʻi Revised Statutes, section 107-24; (3) Recommend amendments to the construction code; and (4) Review technical guidance, policies, and interpretations made by the director relating to the construction code.” SECTION 2. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 3. This ordinance shall take effect upon its approval.
