"! 5 (DRAFT 2) A RESOLUTION AUTHORIZING AND DIRECTING THE DIRECTOR OF FINANCE TO NEGOTIATE THE DISPOSITION OF CERTAIN REAL PROPERTY BY LEASE TO NONPROFIT ORGANIZATIONS FOR PERMANENT HOUSING PURPOSES. WHEREAS, Section 2-120(a)(3) of the Hawaii County Code 1983 (2016 Edition, as amended) (hereinafter the "Code") provides that the Council may, by resolution, direct the Director of Finance to negotiate the disposition of real property by leasing it to governments, governmental agencies, nonprofit organizations, or affordable housing developers at such rentals and on such terms and conditions as deemed proper; and WHEREAS, the Office of Housing and Community Development (hereinafter "OHCD") recently acquired six residential properties (hereinafter the "Properties' identified in Exhibit A, a copy of which is attached hereto and incorporated herein by reference, using Emergency Rental Assistance 2 Program funds; and WHEREAS, on November 5, 2025, OHCD issued a Request for Proposals for the leasehold operation and rental of each of the six residential properties as long-term permanent housing for underserved populations who face significant barriers to secure, safe, and affordable housing; and WHEREAS, upon reviewing all responsive proposals, OHCD wishes to enter into lease agreements for the Properties with the nonprofit organizations as identified in Exhibit A; and WHEREAS, the Properties will be used to provide long-term permanent housing with a minimum lease term of six months for tenants and qualifying households with very low income, meaning income levels at or below fifty percent of the area median income; and WHEREAS, the annual rent for these leases will be $10.00; and WHEREAS, the proposed initial lease term is from April 1, 2026, through March 31, 2027, with four one-year options to renew; and WHEREAS, leasing these Properties to nonprofit organizations for the purpose of providing affordable housing supports the County's ongoing efforts to expand permanent housing opportunities for underserved and vulnerable populations; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, in accordance with Section 2-120 of the Code, the Director of Finance is hereby authorized and directed to negotiate the disposition of certain real property to nonprofit organizations as identified in Exhibit A and for the purposes hereinabove described at such rentals and on such terms and conditions and deemed proper. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to Diane T. Nakagawa, Director of Finance; and Kehaulani M. Costa, Housing Administrator.
