tY of M.� <br />COUNTY OF HAWAI`I STATE OF HAWAI`I <br />BILL NO. 127 <br />(DRAFT 3) <br />ORDINANCE NO. <br />AN ORDINANCE AMENDING CHAPTER 5 OF THE HAWAPI COUNTY CODE 1983 <br />(2016 EDITION, AS AMENDED), RELATING TO THE ESTABLISHMENT OF A <br />CONSTRUCTION CODE COMMISSION. <br />BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAVI: <br />SECTION 1. Chapter 5 of the Hawaii County Code 1983 (2016 Edition, as amended) is <br />amended by adding an article to be appropriately designated and to read as follows: <br />"Article—. Construction Code Commission. <br />Section 5-_-_ General provisions. <br />(a) There shall be a construction code commission consisting of seven members, subject <br />to and appointed in accordance with section 13-4 of the Charter. Members <br />shall possess licensure or substantial experience or expertise in construction or a <br />related field, including, but not limited to, architecture, engineering, electrical work, <br />plumbing, fire protection, building materials, homeowners insurance, construction <br />management, trade representation, general contracting, or self -contracting as a <br />homeowner -builder. <br />(b) The director of public works, the planning director, the fire chief, and the manager - <br />chief engineer of the department of water supply, or their designated representatives, <br />shall serve as ex-officio members of the construction code commission without power <br />to vote. <br />(c) The director of public works shall provide clerical and administrative support to the <br />commission necessary for the performance of its duties. <br />(d) When transmitting any proposed amendment to the construction code, including the <br />adoption of new construction codes, to the Council for its consideration, the director <br />shall also transmit any recommendations and comments from the commission on the <br />proposed amendment. <br />Section 5- Powers and duties. <br />The construction code commission shall have the power to: <br />(1) Advise the mayor, the council, and the director on matters relating to the <br />construction code pursuant to law; <br />(2) Review and evaluate updates to the Hawaii state building codes, except for the <br />Hawaii state fire code, that are being considered by the State building code <br />council pursuant to the Hawaii Revised Statutes, section 107-24; <br />(3) Recommend amendments to the construction code; and <br />
