I gY: June 8, 2000 Hawaii County Council . 25 Aupuni Street Hilo, HI 96720 jpunoD 141"0 FAX: _ - - fl RE: Landfill Fees Dear Councilmember Arakaki: It has come to our attention that certain refuse haulers are severely behind in their landfill fee accounts with the County (see attached spreadsheet). If you divide the total amount owed by a hauler by their current monthly usage, you can see that some of these haulers are over 3 years behind in their payments and it looks as if some of these haulers aren't paying anything at all. As one of the companies that does pay its landfill bill to the County in full and on time, we respectfully request that something be done to correct this situation immediately. In 1997, County Ordinance No. 9746 removed language which required denial of access to County landfills for haulers who didn't pay their fees for landfill use. This Ordinance instead said the County may deny access to landfills. With the County owed as much as three years worth of tipping fees by some haulers, it is obvious that "may" just doesn't carry enough weight to enforce collection of what is owed. We respectfully urge the Council to consider reinstating the original language which required suspension of access to County landfills for non-payment of fees. We would also like to note that the old ordinance required denial of access if payment wasn't made within 60 days of invoicing. As you can see on the spreadsheet, there are now so many haulers behind on their landfill fee that a new ordinance may create an illegal dumping spree. To avoid this situation, we suggest that the new ordinance go into effect at least 6 months from the date of signing, and then allow 90 days before landfill access is denied. This will give haulers time to catch up on their landfill bill, while still putting some teeth in the County's ability to collect debt for services rendered. Finally, we have heard that the Council is considering a bill which would refer this matter to a Solid Waste advisory panel. We would suggest that if such a bill is under consideration, the Council include conditional language which would bar anyone from serving on the panel if they are an owner, manager, or employee of a company that isn't current on its landfill bill; otherwise, we believe it is possible for the advisory panel to be primarily compromised of the representatives of non-paying haulers.
