SUBJECT: PROPOSED SIGNAGE
Waikoloa Road
This letter will serve to confirm our June 13, 2000 telephone conversation regarding your
proposal for the signage within the landscaping area of the Waikoloa Road. Upon consulting
with our Office of the Corporation Counsel and our Department of Public Works Building
Division that regulates signs, we recommend that you take the following course of action.
1. Pursuant to Section 2-111 of the Hawaii County Code, you should apply to the Hawaii
County Council for approval to install the proposed sign, and the existing sign(s) and
landscaping features. A copy of this section is enclosed for your use.
2. The Hawaii County Sign Code, that is administered by our Building Division, allows signs
up to eight (8) square feet in area. Your proposed sign exceeds this code limitation;
therefore, seeking a variance from the County Council is necessary for you.
3. You should also resolve the issues of maintenance and liability with the County Council.
This includes the proposed sign, the existing sign(s), and the landscaping. If the Council
allows these proposals, please keep in mind that the permittee will be responsible for
maintaining this area in perpetuity, and accept all liabilities. p I e

4. Following the County Council's approval, we will require you to submit a construction
plan for this Department to review, and apply for a Permit to Work Within the County
Right-of-Way, for which we will require you to complete before the start of any
construction work.

(l) "Lease" means the right to possess and use real property for a term of one year or more.
(2) "Real property" includes lands and structures or fixtures permanently attached thereto, owned by
the County of Hawaii.
(3) "Remnant" means a parcel of land economically or physically unsuitable or undesirable for
development or utilization as a separate unit by reason of location, size, shape, or other
characteristics. A remnant may be:
(A) Land acquired which is in excess of the needs for which acquired;
(B) Vacated, closed, abandoned, or discontinued road, street or alley or walk, ditch, or other right-
of-way.
(4) "Nonprofit organization" means,an organization organized for other than profit-making purposes
and which is exempted from the Federal income tax by the Internal Revenue Service.
(5) "Affordable housing developer" means an individual or business entity which develops low and
moderate income housing as certified by the housing administrator.

Section 2-111. Powers of council.
(a) Except as otherwise provided by law and subject to other provisions of this article, the council may, by
resolution approved by a majority of its members, direct the finance director or chief engineer:
(1) To dispose.of-.real property,in fee simple by lease; license,*or permit; provided that any lease,
license, or permit whose term is for less than one hundred eighty days may be granted, without the.
necessity of council action, by the finance director or chief engineer through direct negotiation and
without recourse to public auction; -
(2) To grant easement for particular purposes, subject, however, to reverter to the County upon
termination or abandonment of the specific purpose for which it was granted, provided that any
easement may be granted by direct negotiation and without recourse to public auction when the sale
price of such easement is less than $1,000;
(3) To exchange real property for private property.

Section 2-112. Disposition by auction.
Unless the council finds substantial reasons to dispose of real property in some other manner, all
disposition of real property shall be made at public auction, after public notice as provided in section 2-111.
All such auctions shall be held at the main entrance of the County building in which the main office of the
department of finance is located or at such other place as is convenient in the district in which the real
property is located, and shall be conducted by the finance director or by his authorized representative.

Section 2-113. Sale or lease by sealed bids.
Whenever real property are to be sold or leased by call for sealed bids, the finance director shall notify
by publication for a call for bids as provided in section 2-116 with such details concerning the call for bids
as he shall deem necessary and desirable. All bids shall be sealed and delivered to the finance director and
shall be opened by him at the time and place stated in the call for bids. The finance director may reject any
or all bids and waive any defects when in his opinion such rejection or waiver will be for the best interest of
the public.

Section 2-114. Sale or lease by negotiation.
(a) Real property may be sold or leased through negotiation upon a finding by the council that the public
interest demands it.
