HomeMy WebLinkAboutRES 503 Draft 01 2024-2026A RESOLUTION ACCEPTING THE DEDICATION OF A ROADWAY LOT IDENTIFIED AS LOT 7-A-2, BEING A PORTION OF THE PROPERTY IDENTIFIED AS TAX MAP KEY NO. (3) 2-8-007:085, SITUATED AT PEPE‘EKEO AND MAKAHANALOA, DISTRICT OF SOUTH HILO, ISLAND, COUNTY, AND STATE OF HAWAI‘I. WHEREAS, Ryan Okano and Lennie Okano-Kendrick, Co-Trustees of the Okano Family Irrevocable Trust, dated March 13, 2018, (hereinafter, the “Owners”) own a roadway lot identified as Lot 7-A-2, (hereinafter, the “Roadway”) being a portion of the property identified by Tax Map Key No. (3) 2-8-007:085, situated at Pepe‘ekeo and Makahanaloa, District of South Hilo, Island, County, and State of Hawaiʻi, as described in “Exhibit A” and depicted in “Exhibit B”, both of which are attached hereto and made a part hereof; and WHEREAS, the Owners wish to dedicate the Roadway and all improvements thereon to the County of Hawaiʻi (hereinafter, the “County”); and WHEREAS, Section 23-10 of the Hawaiʻi County Code (2016 Edition, as amended) (hereinafter, “the Code”) prohibits the Council from receiving, by dedication, any street in a subdivision platted after December 21, 1966, except upon full compliance with the provisions of Chapter 23; and WHEREAS, the Department of Public Works, having inspected the Roadway and found it to be in dedicable condition and in full compliance with the provisions of Chapter 23, recommends that the Council accept dedication of the Roadway; and WHEREAS, Article XIII, Section 13-12, of the Charter of the County of Hawaiʻi provides that the Council may accept gifts, including real estate or any interest in real estate, on behalf of the County; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAIʻI that, pursuant to Article XIII, Section 13-12 of the Charter of the County of Hawaiʻi, this body hereby accepts the dedication of the Roadway for public road purposes. BE IT FURTHER RESOLVED that this body finds that the Roadway and all improvements thereon are in full compliance with the provisions of Chapter 23 of the Code as certified and approved by all applicable agencies, and that it is in the public interest to accept such dedication. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable C. Kimo Alameda, Mayor of the County of Hawaiʻi; Wesley R. Segawa, Director of Public Works; Sinclair Salas-Ferguson, Deputy Corporation Counsel; Ryan Okano, 94-245 Kikiula Loop, Mililani, HI 96789; and Lennie Okano-Kendrick, P.O.
