RESOLUTION NO.
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS OF LATER FISCAL
YEARS TO ENTER INTO A MULTI -YEAR LEASE AGREEMENT FOR REAL
PROPERTY TO BE USED BY THE HAWAPI FIRE DEPARTMENT.
WHEREAS, Section 10-11 of the Charter of the County of Hawaii (hereinafter "the
Charter") provides, in part, that "any contract, lease or other obligation requiring the payment of
funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made
or approved by resolution'; and
WHEREAS, the Hawaii Fire Department (hereinafter "the Tenant") wishes to re-enter
into a multi -year lease agreement with Maui Varieties Investments, Inc., a Hawaii corporation,
as tenant in severalty (hereinafter "the Landlord"), with a term of five years commencing on or
about May 1, 2026, and not to exceed April 30, 2031; and
WHEREAS, this space has historically been used since 2013 to house one Paramedic
and one Emergency Medical Technician during their twenty -four-hour daily shifts; and
WHEREAS, continued use of this space is necessary to provide emergency medical
services to the NR'51chu community; and
WHEREAS, the Tenant estimates the monthly cost of this agreement to be $2,547.23,
plus an additional charge to pay the Hawaii general excise tax, which is currently 4.712%; and
WHEREAS, the two units to be leased under this proposed agreement are Unit Nos. 226
and 120, both located at 95-1163 Ka`alaiki Road, Nd'dlehu, Hawaii 96772, identified by Tax
Map Key No. (3) 9-5-021:026; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that the
Mayor is hereby authorized to enter into a multi-year lease agreement with the Landlord for a
term of five years, for the purposes hereinabove described.
BE IT FURTHER RESOLVED that, in accordance with Section 10-11 of the Charter,
sufficient funds be budgeted in later fiscal years to cover the anticipated obligations of the
County under the terms of the lease agreement.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Honorable C. Kimo Alameda, Mayor of the County of Hawai`i; Diane T.
Nakagawa, Director of Finance; Daniel J. Volpe, Acting Fire Chief of the Hawai'i Fire
Department; and Maui Varieties Investments, Inc., 2810 Pa`a Street, Suite 10, Honolulu, Hawai`i
96819.
