A RESOLUTION AMENDING THE RULES OF PROCEDURE AND ORGANIZATION OF THE COUNCIL OF THE COUNTY OF HAWAI‘I BY REPEALING RULE NO. 7 AND ADDING A RULE RELATING TO PERMITTED INTERACTION GROUPS.
WHEREAS, on December 2, 2024, the Council of the County of Hawai‘i (hereinafter, the “Council”) adopted the Rules of Procedure and Organization of the Council of the County of Hawai‘i
(hereinafter, the “Rules”) as provided in Resolution No. 3-25 to govern the affairs of the Council; and
WHEREAS, Rule No. 16-1 provides, in part, that the Rules “may be amended at a regular Council meeting by a resolution approved by an affirmative majority vote of the entire membership
of the Council”; and
WHEREAS, the Council finds that Rule No. 7 bears further consideration and clarification; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that Rule No. 7 of the Rules is hereby substituted with the following:
“RULE NO. 7
PERMITTED INTERACTION GROUPS
1. Establishment. A permitted interaction group may be established only by the affirmative vote of a majority of the entire membership of the Council or a Standing Committee at a duly
noticed meeting, in accordance with these rules and applicable law. The motion establishing the permitted interaction group shall:
(a) Define the scope of the investigation or assignment and the authority of the permitted interaction group; and
(b) Identify the Chairperson and members of the permitted interaction group.
2. Membership. A permitted interaction group shall consist of no fewer than two (2) and no more than four (4) members of the Council or a Standing Committee.
3. Findings and Recommendations. All findings, reports, and recommendations shall be presented at a duly noticed meeting of the Council or Standing Committee that established the permitted
interaction group.
4. Deliberation and Decision-Making. Deliberation and decision-making on an investigated matter shall occur only at a duly noticed meeting held after the meeting in which the findings
and recommendations of investigations were presented to the Council or Standing Committee.
5. Compliance with Law. All permitted interaction groups shall be conducted in strict compliance with Chapter 92, Hawaiʻi Revised Statutes.”
BE IT FINALLY RESOLVED that the County Clerk shall prepare and transmit to all appropriate parties a copy of the Rules, as amended herein, to replace the existing portions rendered obsolete
by this amendment.
