RESOLUTION NO. 474-26

A RESOLUTION AUTHORIZING THE MAYOR TO ENTER INTO AN
INTERGOVERNMENTAL AGREEMENT WITH THE STATE OF HAWAI% HILO
BENIOFF MEDICAL CENTER, TO AUTHORIZE PRIVATE OFF-STREET PARKING
AT GILBERT CARVALHO PARK.
WHEREAS, Section 46-7 of the Hawaii Revised Statutes requires the consent of the
Council in order for the County to enter into an agreement with the federal government or any
other public body respecting action to be taken pursuant to any of the powers granted to the
County by law and furnish, expend, and receive any funds or other assistance in connection with
projects being or to be undertaken pursuant to those powers; and
WHEREAS, the State of Hawaii, Hilo Benioff Medical Center, (hereinafter "HBMC”)
desires to enter into an agreement with the County of Hawaii, Department of Parks and
Recreation, (hereinafter the "County") to use a portion of the land identified by Tax Map Key
No. (3) 2-3-026:005, situated at Pi`ihonua, District of South Hilo, also known as Gilbert
Carvalho Park (hereinafter the "Property") for parking purposes; and
WHEREAS, the County retains control and management authority over the Property
under Executive Order No. 3774; and
WHEREAS, HBMC is undertaking multiple large-scale construction projects for the
improvement and expansion of medical and associated facilities located approximately one mile
from the Property; and
WHEREAS, the ongoing construction has negatively affected the availability of parking
for HBMC's employees, agents, officers, contractors, representatives, and volunteers; and
WHEREAS, as a result, HBMC wishes to use a portion of the Property to be designated
by the County as parking space for its employees, agents, officers, contractors, representatives,

and volunteers for a perio�iof time not to exceed December 31, 2027; and
WHEREAS, this proposed agreement does not involve the expenditure or receipt of any
funds; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that,
pursuant to Section 46-7 of the Hawai`i Revised Statutes,the Mayor is hereby authorized to enter
into an agreement with the State of Hawaii, Hilo Benioff Medical Center, for the purposes
hereinabove described.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Honorable C. Kimo Alameda,Mayor of the County of Hawai`i; J S. Yoshimoto,
Assistant Corporation Counsel; and Clayton S. Honma, Parks and Recreation Director; and Hilo
Benioff Medical Center, 1190 Waianuenue Avenue,Hilo,HI 96720.
