HomeMy WebLinkAboutRES 524 Draft 01 2024-2026COUNTY OF HAWAPI STATE OF HAWAI`I RESOLUTION NO. 524 26 A RESOLUTION ACCEPTING A DONATION OF AN INDUSTRIAL DISHWASHER AND DISH COLLECTION BIN FOR THE HO`I RETURNABLE DISH PROGRAM TO BE USED BY THE DEPARTMENT OF ENVIRONMENTAL MANAGEMENT. WHEREAS, Article JHII, Section 13-12, of the Charter of the County of Hawaii (hereinafter "the Charter") provides that the Council, "on behalf of the county, may accept gifts of donations of money, securities or other personal property or of real estate or any interest in real estate"; and WHEREAS, Chapter 2, Article 30, Section 2-162(a), of the Hawaii County Code 1983 (2016 Edition, as amended) (hereinafter "the Code") provides, in part, that "gifts or donations of money, securities, or personal property which fall within the capitalization procedures of the department of finance may be accepted by resolution approved by the council"; and WHEREAS, Perpetual Use Inc., a non-profit entity, (hereinafter, "Perpetual") wishes to donate an industrial dishwasher with an estimated value of $245,000 and a dish collection bin with an estimated value of $3,571 to the Department of Environmental Management (hereinafter, "DEM"); and WHEREAS, this dishwasher and dish collection bin are intended to be used for the Ho`i Returnable Dish Program, a community -wide reuseable foodware program designed and implemented by DEM, Perpetual, Zero Waste Hawaii Island, and the University of Hawaii Sea Grant Program; and WHEREAS, in 2024, the United States Environmental Protection Agency (hereinafter, "EPA") awarded the County $1,522,130 in grant funding through the Solid Waste Infrastructure for Recycling grant program (hereinafter, "SWIFR') to support program infrastructure; and WHEREAS, due to EPA administrative delays in processing the procurement waiver necessary for the dishwasher, a secondhand dishwasher was purchased through other funding sources; and WHEREAS, alternate funding sources allowed for the purchase of a secondhand machine with higher throughput capabilities at a lower cost than would have been otherwise possible through SWIFR funds; and WHEREAS, S WIFR funds will be used to purchase one hundred collection bins through an Invitation to Bid process, however, the project partners required one bin to accurately portray the process of participating in the Ho`i Returnable Dish Program, which Perpetual was able to purchase with other grant funds; and s ;r WHEREAS, because the dishwasher and dish collection bin were purchased using non- SWIFR funds, Perpetual currently owns the dishwasher and dish collection bin; and WHEREAS, on December 29, 2025, the County entered a contract with a reuse provider to operate the reuse program through Request for Proposals No. 4598 - Hilo Reusable Foodware System; and WHEREAS, as part of the contract, the County is providing no -cost use of key equipment and supplies, including the dishwasher and dish collection bin to the operator; and WHEREAS, this ownership transfer aligns the equipment with the County's role as the lead public agency for the Ho`i Returnable Dish Program, ensures proper stewardship of core program infrastructure, and supports long-term operational continuity; and WHEREAS, DEM is grateful for this donation and recommends its acceptance by the Council; now, therefore, 2 BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, pursuant to Section 13-12 of the Charter and Section 2-162 of the Code,the donation from Perpetual Use Inc. hereinabove described is hereby accepted.
