AN ORDINANCE AMENDING CHAPTER 24,ARTICLE 10,DIVISION 5,SECTION 24- 280,SCHEDULE 28 OF THE HAWAI`I COUNTY CODE 1983 (2016 EDITION,AS AMENDED),RELATING TO NO PARKING AT ANYTIME. BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI`I: SECTION 1. The purpose of this ordinance is to prohibit parking along narrow shoulder segments of Ali`i Drive fronting Kahalu`u Beach Park to improve safety for pedestrians and motorists in the area. SECTION 2. Chapter 24,article 10,division 5, section 24-280, schedule 28,entitled "No parking at anytime,"subsection(f),Kona, of the Hawai`i County Code 1983 (2016 Edition, as amended), is amended by amending the following listings to read as follows: AIi`i Drive, [makai] west(makai) side, [` . • v,t, ] from a point five hundred thirty- three feet north of Makole`a Street and extending to a point one hundred forty-six feet south of Makole`a Street." "• Ali`i Drive,west(makai) side, from a point[ninek ]one thousand ninety-two feet north of Makole`a Street and extending [thirty thr one hundred seventy-seven feet in a southerly direction." SECTION 3. Chapter 24, article 10, division 5,section 24-280,schedule 28,entitled "No parking at anytime," subsection (f),Kona,of the Hawaii County Code 1983 (2016 Edition, as amended), is further amended by repealing the following listings as follows: ]„ ]„ SECTION 4. Material to be repealed is bracketed and stricken.New material is underscored. In printing this ordinance, the brackets, bracketed and stricken material, and underscoring need not be included. SECTION 5. Severability. If any provision of this ordinance, or the application thereof to any person or circumstance, is held invalid,the invalidity does not affect other provisions or applications of the ordinance which can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable. SECTION 6. This ordinance shall take effect upon its approval.
