HomeMy WebLinkAboutRES 569 Draft 01 2024-2026A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS FROM LATER FISCAL YEARS TO ENTER INTO A MULTI-YEAR LEASE AGREEMENT FOR WAREHOUSE SPACE TO BE USED BY THE DEPARTMENT OF PUBLIC WORKS. WHEREAS, Section 10-11 of the Charter of the County of Hawai‘i (hereinafter “the Charter”) provides, in part, that “any contract, lease or other obligation requiring the payment of funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made or approved by resolution”; and WHEREAS, the Department of Public Works (hereinafter the “Department”) wishes to enter into a multi-year lease agreement, with a term of three years, for use of warehouse space identified as Bays A1/A2, located at 73-4081 Hulikoa Drive, Kailua-Kona, being a portion of the property identified as Tax Map Key No. (3) 7-3-058:019, (hereinafter, the “Warehouse”) owned by Geo Investment Company, Inc.; and WHEREAS, the Warehouse will be used by the Department’s West Hawaiʻi Traffic Signals and Street Lights section (hereinafter, the “Section”) for storage and as a covered work area; and WHEREAS, one of the primary responsibilities of the Section is the operation and maintenance of traffic signals in West Hawaiʻi; and WHEREAS, while much of the Section’s traffic signal maintenance and operational work is on Highway 11, Highway 19, and Kuakini Highway in Kailua-Kona, the Section currently operates from a County-owned baseyard shared with the Department’s Automotive Division in Captain Cook; and WHEREAS, the planned renovation of a County-owned property on Hulikoa Drive to permanently accommodate the Section will not be completed for several years; and WHEREAS, leasing the Warehouse will provide the Section with a location closer to the primary response area and create much-needed space in the baseyard for use by the Automotive Division; and WHEREAS, the Department estimates an initial security deposit of $4,896 and the monthly cost of this agreement to be approximately: 1. $3,240 from May 1, 2026, to March 31, 2027; 2. $3,360 from April 1, 2027, to March 31, 2028; and 3. $3,480 from April 1, 2028, to February 28, 2029; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that the Mayor is hereby authorized to enter into an agreement, with a term of three years, for the purposes hereinabove described. BE IT FURTHER RESOLVED that, in accordance with Section 10-11 of the Charter, sufficient funds be budgeted in later fiscal years to cover the anticipated obligations of the County under the terms of the agreement. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to William V. Brilhante, Jr.; Managing Director; Diane T. Nakagawa; Director of Finance; and Wesley R.
