HomeMy WebLinkAboutRES 575 Draft 01 2024-2026A RESOLUTION AUTHORIZING THE ACCEPTANCE OF ALL DONATIONS OF SECURITIES OR PERSONAL PROPERTY NOT COVERED UNDER THE CAPITALIZATION PROCEDURES OF THE DEPARTMENT OF FINANCE THAT ARE RECEIVED DURING THE FISCAL YEAR ENDING JUNE 30, 2027. WHEREAS, Article XIII, Section 13-12, of the Charter of the County of Hawaiʻi provides that the Council, “on behalf of the county, may accept gifts of donations of money, securities or other personal property or of real estate or any interest in real estate”; and WHEREAS, Chapter 2, Article 30, Section 2-162(b), of the Hawai‘i County Code 1983 (2016 Edition, as amended) states that a “gift or donation of money, securities, or personal property not covered by the capitalization procedures shall be submitted to the council by letter for its approval”; and WHEREAS, donations of commodities not covered by the capitalization procedures of the Department of Finance are made by various entities throughout the year to the County and are accepted by the Council via letter during a duly noticed meeting of the Council; and WHEREAS, although both the executive and legislative branches of the County place a high priority on expediting the acceptance of these donations, the process is often lengthy; and WHEREAS, it is in the best interest of the public that a more expeditious manner of accepting uncapitalized donations be implemented; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that, henceforth, all donations received during the fiscal year ending June 30, 2027, that are not covered by the capitalization procedures of the Department of Finance are hereby accepted by the Council, on behalf of the County, upon receipt by the County, provided that, at the end of each quarter, a report of the donations received is submitted to the Council by the Director of Finance. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to the Honorable C. Kimo Alameda, Mayor of the County of Hawaiʻi; Diane T.
