Aloha Counrdlmember Pisicchio,
We have a serious need for affordable housing in Hawaii County due to the continuing high
unemployment of and low salaries paid to our community members All too freauently develnnerc
create new subdivisions for high-end lots and/or homes generating multi-millions of dollars in net
profit to the developer. Between the developers, the Planninq Commission. and the Plannino
Director, the developers are allowed to breach the intent of the law for the affordable housing
needs of our community. Our current code allows the developers to buy their way out of affordable
housing requirements with a tiny amount of money compared to the mufti-millions in net profit.
Meanwhile, our community members cannot afford to obtain adequate housing for themselves or
melr crincren.
On November 24, 1994, the Affordable Housing Section (11-4), had its requirement for "payment of
in-lieu fees" reduced from $19,000 to $4720 ner affordable unit. It is impossible to place a family
for even a year in adeauste housing at this ridicuWsly low fee. It certainly constrains the Hawaii
County Housing Agency (HCHA) from building any new, low-income housino for our people. This
situation should not be allowed to exist.
Now, Resolution 279-00 revisits the amount of "payment of in-lieu fees" paid by Bayvlew Estates at

for all developers at this time. However, we believe that:
1. The minimum number of low-income housing units required to be provided by the developer
remain at ten percent 110%) of total units when ten or more 1lnits are in the subdivision
(rounded MR to the next higher number);

developers from any attempt to circumvent this requirement by re-subdividing the lots; and
