RESOLUTION NO. 586 26
A RESOLUTION AUTHORIZING THE PLANNING DEPARTMENT TO AWARD
FUNDS TO POHAKU PELEMAKA THROUGH THE KILAUEA RECOVERY GRANT
PROGRAM.
WHEREAS, Chapter 2,Article 25, Section 2-139(a)(3)(A)of the Hawai`i County Code
1983 (2016 Edition, as amended) (hereinafter, "the Code")provides that grants awarded"in
excess of$25,000 to nonprofit organizations shall specifically identify the organization receiving
the grant funds and the purpose for which the grant funds shall be used in a resolution"; and
WHEREAS, Chapter 2,Article 25, Section 2-136 of the Code defines"nonprofit
organization"as "an organization that is registered and in good standing in the State of Hawaii
as a nonprofit organization and maintains a 501(c)(3) charitable designation from the Internal
Revenue Service"; and
WHEREAS,the two projects (hereinafter, "the Projects") specified in"Exhibit A",
attached hereto and incorporated herein by reference,were previously approved of by the
Council through Resolution No. 459-26; and
WHEREAS, Pohaku Pelemaka, which correspondingly qualifies as a nonprofit
organization as defined above, has agreed to sponsor the Projects after the original fiscal sponsor
needed to withdraw; and
WHEREAS,the Planning Department wishes to provide a total of$142,000.00 to
Pohaku Pelemaka, as outlined in"Exhibit A"; now,therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that, in
accordance with Chapter 2,Article 25, Section 2-139 of the Code,the grant awards as identified
in "Exhibit A" are hereby approved.

BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to the Honorable C.Kimo Alameda,Mayor of the County of Hawai`i;Diane T.
Nakagawa,Director of Finance; and Jeffrey W.Darrow,Planning Director.
