HomeMy WebLinkAboutRES 545 Draft 02 2024-2026COUNTY OF HAWAI`I •� "• STATE OF HAWAI`I 'ie•c's •Hr� RESOLUTION NO. 545 2G (DRAFT 2) A RESOLUTION AMENDING RULE NO.2 OF THE RULES OF PROCEDURE AND ORGANIZATION OF THE COUNCIL OF THE COUNTY OF HAWAPI, RELATING TO EXCUSED AND UNEXCUSED ABSENCES. WHEREAS, on December 2, 2024, the Council of the County of Hawaii (hereinafter, the "Council") adopted the Rules of Procedure and Organization of the Council of the County of Hawai `i (hereinafter, the "Rules") as provided in Resolution No. 3-25 to govern the affairs of the Council; and WHEREAS, Rule No. 16-1 provides, in part, that the Rules "may be amended at a regular Council meeting by a resolution approved by an affirmative majority vote of the entire membership of the Council"; and WHEREAS, the Council finds that Rule No. 2 bears further consideration and clarification; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI`I that Rule No. 2 of the Rules is hereby amended by substituting subrule 9 with the following: "9. Excused and Unexcused Absences. (a) A Council Member who is unable to attend a Council or Committee meetingshall hall provide written notice to the Council Chairperson as soon as practicable stating the reason for the absence. (b) The Council Chairperson shall determine whether an absence is excused or unexcused based on the information provided and any additional relevant circumstances. In making such determination, the Chairperson may consider, among other factors: 1 Illness medical treatment or any health -related condition of the member or an immediate family member; 2 Official County business or governmental service requiring the member's attendance elsewhere; 3 Family emergency, bereavement or significant personal obligation; or 4 Unavoidable travel disruption or other circumstance beyond the reasonable control of the member. (c) The determination of the Council Chairperson shall be announced by the Council Chairperson or by the apl2licable Committee Chairperson for the record. (d) A determination of an absence may be appealed to the Council by communication submitted to the Council Chairperson, which shall be placed on the next available Council agenda. Approval of the appeal shall require the affirmative vote of a majority of the entire membership of the Council. (e) Nothing in this subrule shall limit the authority of the Council to take action regarding repeated absences as provided by the Charter of the County of Hawai`i or other applicable law." BE IT FINALLY RESOLVED that the County Clerk shall prepare and transmit to all appropriate parties a copy of the Rules, as amended herein,to replace the existing portions rendered by this amendment;provided that, in preparing said pages,the underscoring need not be included.
