HomeMy WebLinkAboutRES 605 Draft 01 2024-2026A RESOLUTION DIRECTING THE COUNTY CLERK TO TAKE NECESSARY ACTION TO PLACE THE CHARTER AMENDMENT PROPOSED BY ORDINANCE NO. 26-47, RELATING TO THE OFFICE OF THE COUNTY AUDITOR, ON THE 2026 GENERAL ELECTION BALLOT. WHEREAS, Article XV, Section 15-2, of the Charter of the County of Hawai‘i (2024 Edition) (hereinafter the “Charter”) provides, in pertinent part, “[u]pon adoption of an ordinance proposing amendments or revisions of this charter… the council shall by resolution provide that the proposed amendments or revisions be submitted to the electors of the county for approval at the next general election”; and WHEREAS, Section 15-2 of the Charter further provides that “[a]ny such resolution shall provide for the publication of the full text of the proposed amendments or revisions in a daily newspaper of general circulation in the county at least forty-five days prior to submission to the electors of the county as well as via an electronic medium, such as the Internet”; and WHEREAS, Section 15-1 requires that an ordinance proposing a Charter amendment be adopted after three readings on separate days and passed by the affirmative vote of two-thirds of the entire membership of the Council; and WHEREAS, Section 11-119(b) of the Hawai‘i Revised Statutes requires that questions and issues to be placed on the general election ballot must be submitted to the State chief election officer no later than 4:30 p.m. on the seventy-fifth calendar day before the general election; and WHEREAS, Bill No. 152, which proposes an amendment to the Charter relating to the Office of the County Auditor, was duly adopted by the Council after three readings on the following dates and by the following votes: Reading Date Vote   First Reading May 20, 2026 9 ayes   Second Reading June 3, 2026 8 ayes, 1 absent   Third Reading June 17, 2026 8 ayes, 1 absent ; and   WHEREAS, Mayor C. Kimo Alameda signed Bill No. 152 into law as Ordinance No. 26-47 on June 26, 2026; and WHEREAS, Ordinance No. 26-47 was published in compliance with Section 3-10(h) of the Charter on July 2, 2026; now, therefore, BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I that, in accordance with Section 15-2 of the Charter, this body hereby directs the County Clerk to take all necessary actions provided for by the Charter, the Hawai‘i Revised Statutes, and other applicable law to submit the Charter amendment proposed by Ordinance No. 26-47 to the electors of the County for approval at the next general election scheduled for November 3, 2026. BE IT FURTHER RESOLVED that the County Clerk is specifically directed to: Submit the ballot question for the proposed amendment to the State chief election officer no later than 4:30 p.m. on Thursday, August 20, 2026, which is the seventy-fifth calendar day before the general election; and Publish the full text of the proposed amendment in the Hawai‘i Tribune-Herald and the West Hawai‘i Today, two newspapers of general circulation in the County, no later than Saturday, September 19, 2026, which is the forty-fifth day prior to the general election, as well as via an electronic medium, such as the Internet. BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this resolution to Scott T. Nago, Chief Election Officer, State of Hawai‘i.
