RESOLUTION NO. 612 2E
A RESOLUTION AUTHORIZING THE PAYMENT OF FUNDS FROM LATER
FISCAL YEARS TO ENTER INTO A MULTI-YEAR AGREEMENT FOR ONLINE
LEGAL RESEARCH SERVICES AND LEGAL PRINT RESOURCES FOR THE
OFFICE OF THE CORPORATION COUNSEL.
WHEREAS, Section 10-11 of the Charter of the County of Hawai`i (hereinafter"the
Charter")provides, in part,that"any contract, lease or other obligation requiring the payment of
funds from the appropriations of a later fiscal year or of more than one fiscal year shall be made
or approved by resolution"; and
WHEREAS,the Office of the Corporation Counsel (hereinafter"the Department")
wishes to enter into an online legal research services and legal print resources,with a term of five
years, for proprietary software and other services from West Publishing Corporation on behalf of
Thomson Reuters Enterprise Centre GmbH,under the Westlaw legal research services; and
WHEREAS,the Westlaw legal research services provide essential online legal research
services for the Department that are necessary to properly advise and represent the County in
legal matters; and
WHEREAS, continued use of the Westlaw legal research services is necessary for
numerous County legal matters; and
WHEREAS,the Department estimates a year monthly cost of this agreement to be
approximately$13,522.08 upon execution of the contract until December 31,2026 and then
$14,245 per month until the end of year one,with an increase of 7%per year thereafter that
includes all software updates, and a year five monthly cost of$18,672.29; now, therefore,
BE IT RESOLVED BY THE COUNCIL OF THE COUNTY OF HAWAII that the
Mayor is hereby authorized to enter into an agreement,with a term of five years, for the purposes
hereinabove described.
• BE IT FURTH ER RESOLVED that, in accordance with Section 10-11 of the Charter,
sufficient funds be budgeted in later fiscal years to cover the anticipated obligations of the
County under the terms of the agreement.
BE IT FINALLY RESOLVED that the County Clerk shall transmit a copy of this
resolution to William V. Brilhante, Jr., Managing Director; Diane T.Nakagawa, Director of
Finance; and Renee N. C. Schoen, Corporation Counsel.
