HomeMy WebLinkAboutBIL 189 Draft 01 2024-2026AN ORDINANCE AMENDING CHAPTER 14, ARTICLE 25, SECTION 14-151, OF THE HAWAI‘I COUNTY CODE 1983 (2016 EDITION, AS AMENDED), RELATING TO CLEARING UNSAFE FLORA.
BE IT ORDAINED BY THE COUNCIL OF THE COUNTY OF HAWAI‘I:
SECTION 1. Chapter 14, article 25, section 14-151, of the Hawaiʻi County Code 1983 (2016 Edition, as amended), is amended by amending subsection (a) to read as follows:
“(a) If a majority of all the adult residents within a radius of five hundred feet from any boundary of, or the property owner of a property adjacent to or abutting, any occupied or
unoccupied lot, in writing to the mayor requests that the lot be cleared of refuse, uncultivated undergrowth, or unsafe flora, the mayor or a designated department shall investigate
the complaint. If the mayor or the designated department, in consultation with an appropriate expert, certifies that there is refuse, uncultivated undergrowth, or unsafe flora on the
lot complained about to an extent that the lot poses or is likely to pose an imminent danger for fire, health, safety, property damage, or crime hazard, the mayor shall notify the owner
of the lot to clear the occupied or unoccupied lot of the refuse, uncultivated undergrowth, or unsafe flora.”
SECTION 2. New material is underscored. In printing this ordinance, the underscoring need not be included.
SECTION 4. Severability. If any provision of this ordinance, or the application hereof to any person or circumstance, is held invalid, the invalidity does not affect other provisions
or applications of this ordinance that can be given effect without the invalid provision or application, and to this end the provisions of this ordinance are severable.
SECTION 5. This ordinance shall take effect upon its approval.
